Illegal immigrant sex offender free after posting bail in North Salem

NORTH SALEM - An illegal immigrant arrested by state police this week and accused of failing to register as a sex offender is free after posting $10,000 bail in North Salem Court.
The town justice who set the bail that allowed Jose M. Broudwiack to walk free for now, John J. Johnston Jr., declined to comment today on his decision.
Broudwiack, 48, of 2 Sugar Hill Road in the Purdys section of town, is a previously deported felon and a fugitive from justice in California who re-entered the country illegally, state police said.
He moved to Sugar Hill Road about two years ago but failed to register as a sex offender with police, as required by law, state police. Investigator Cornelius Merritt of the Somers barracks charged him Wednesday with failing to register, a misdemeanor.
Police said Broudwiack was convicted in 1999 in California of lewd or lascivious acts with a child under 14. He served time in jail, was released and made to register as a sex offender in California before being deported to his native Peru. He re-entered the country illegally sometime in the past few years.
State police only learned recently that he was living in North Salem, Senior Investigator Patrick Bosley said.
State police said they contacted immigration officials, who issued a detainer warrant for possible deportation proceedings. Police said the warrant can only be enforced by a holding facility, such as the county jail.
But Broudwiack never went to jail.
He posted the bond set by Justice Johnston on Wednesday and walked out of court. His next court date is Nov. 26.
Johnston declined to discuss his reasons for setting a bond that Broudwiack was able to post.

He's gone!
Actually, the city needs to change their policy and refuse bail to all illegal aliens. They are all flight risk. Secondly, that bail was not set high enough.
