An illegal immigrant shot by police at a downtown Seattle bus stop last week is out of the hospital and in King County Jail.

Jose M. Cardenas-Muralta was booked for investigation of assault and weapons violations. He is being held on $250,000 bail, according to prosecutors.

Dan Donohoe, spokesman for the King County Prosecuting Attorney's Office, said they expect to file charges by Wednesday.

Cardenas-Muralta, 38, was deported from Washington to Mexico in 2008 and is in the country illegally, according to U.S. Immigration and Customs Enforcement (ICE). He has a criminal history in Washington. He will be deported again once the criminal proceedings against him are resolved, according to ICE's Lorie Dankers.

Cardenas-Muralta was shot in the torso by Seattle police Officer Chris Myers a week ago Tuesday after police got a call reporting a man brandishing a weapon.

When Myers and a partner responded, the man was uncooperative and tried to walk off, so the officers tried to corner him. Police said one officer got out his Taser and then saw the suspect reach into his waistband and grab what appeared to be a metallic object.

The officer dropped the Taser and shot Cardenas-Muralta, police said.

Police found an unloaded handgun in Cardenas-Muralta's waistband.
