McAuley pleads guilty on bad check charges in Helena court



Kevin Barry McCauley, an illegal Irish Immigrant charged with writing more than $40,000 in bad checks to Helena merchants, changed his plea to guilty on Wednesday.

McCauley appeared in Helena District Court charged with felony bad checks by common scheme.

McCauley wrote at least one of those checks as a down payment on the purchase of O'Malley's Bar last summer.

The bad checks were drawn off his American Federal Bank account.

McCauley had been living in the Helena area for the past few years, before leaving and being arrested by the Department of Homeland Security in Denver.

He was brought back to Montana on the bad check charges.

During Wednesday's court session, Judge Dorthy McCarter told McCauley, "You could be required to pay restitution as part of your sentence. If you are not a United States citizen a conviction could result in your deportation. And this conviction could affect your sentence that you could receive in the future for another offense that you might commit."

According to Dan Butler who lives in Canada, this shouldn't be McAuley's first felony offense.

Butler met McAuley in 2007, whose alias at the time was Gabrial Hoverty.

He said that he and another partner were to buy into an Irish pub. However, "Gabe's" check never cleared, and a few months later, he absconded with the money.

Butler said, "So Stu went to check the account and he (Gabe) had closed them out. The money was all gone. And we phoned the cops like a second later."

According to U.S. District Court documents, McAuley has used at least six bogus names

Butler says that McAuley's modus operandi is to befriend people of Irish descent.

He talks of owning land and a house in Ireland, and that he was a sniper in the Irish Army.

In hindsight, Butler scoffs at such claims: "He doesn't own anything, he doesn't own a mountain in Ireland and he doesn't own any land in Ireland, he's got no family. He's a scammer."

While Butler realizes that they likely won't get their money back, he's fearful that McAuley will find his way back and do it again.

Butler's preferred solution: "Send him back to Ireland and keep him there."

These previous allegations are irrelevant however, as Deputy County Attorney Mike Menahan can only prosecute for the Montana charges.

And on those Montana charges, McCauley faces up to 10 years in prison and up to $50,000 in fines.

His sentencing is scheduled for April 25.
