    Illegal sentenced for dragging another man with car

    Man sentenced for dragging another man through Riverhead with his car

    Riverside man accused of dragging a man from his car for nearly a mile while driving drunk through Riverhead was sentenced Thursday to 3 1/3 to 10 years in prison.

    Alejandro Xuya-Sian pleaded guilty last month to charges including vehicular assault, leaving the scene of an accident and driving while intoxicated in April. Suffolk prosecutors say Xuya-Sian was driving with a .08 percent blood-alcohol level when he struck Anselmo Chin-Sabam in the parking lot of a Riverhead bar. Chin-Sabam became lodged in the front left wheel of the car, and had his skin shredded as Xuya-Sian drove three-quarters of a mile before realizing he was there.

    Assistant District Attorney Thalia Stavrides said Xuya-Sian "stopped the car, got out and undoubtedly dislodged him from the car," then went on his way – crashing into a tree about two miles later.

    Chin-Sabam suffered first-degree burns on more than 40 percent of his body, multiple fractures, and had some parts of his body torn to the muscle, Stavrides said. He is still recovering, and was in no condition to be in court Thursday, she said.

    Stavrides called the defendant's actions "devoid of compassion for mankind." Suffolk County Court Judge James Hudson agreed, telling Xuya-Sian that he not only seriously injured the victim, but also "shattered his life. You left him lying in the road – less that you would be expected to treat an injured animal." Hudson said he would recommend that Xuya-Sian, an illegal immigrant from Guatemala, be deported when he completes his sentence.

    Xuya-Sian was about to speak in court, when his Legal Aid attorney, Bryan Browns, advised against it. Browns said his client regrets his actions and takes full responsibility for them.

    "I think his time in prison is going to allow him to reflect and get on with his life," Browns said in court.

    This dragging people behind cars seems to be a normal part of life for these people, I have never heard of such a thing until the last year, now it is becoming a common occurance.

    "You didn't just injure him physically. You shattered his life," Suffolk County Judge James Hudson told Xuya-Sian before he imposed his sentence. Hudson said Xuya-Sian treated his victim with less regard than he should "an injured animal."

    Xuya-Sian, 27, pleaded guilty last month to vehicular assault, driving while intoxicated, leaving the scene of an accident and other charges.

    Given the opportunity to make a statement before receiving his sentence, Xuya-Sian began speaking when his Legal Aid attorney, Bryan Browns, interrupted him. Browns took him to the side, and then said his client would remain silent.

    Browns said Xuya-Sian, an illegal immigrant, had two children and a wife in his native Guatemala and had been working a $450-a week job to help support them.

    "He regrets and he takes full responsibility for what happened," Browns said in court. "I think his time in prison is going to allow him to reflect and get on with his life."

    Hudson said he would recommend that Xuya-Sian be deported after completing his sentence -- a sentence that Hudson said was "too lenient" because of limitations of law.

    "[The sentence] is not enough to give consolation to your victim that this is how such a violation of his body was punished," Hudson said.

    I agree. There was a case a while back where a drunken young woman had a fight with her boyfriend and drove off with him caught under the car, dragging him to his death. I don't get it. If the car obviously is not driving properly, wouldn't most Americans get out to see what is wrong? It seems like the Mexican response is to floor it.

    Just the other day a minister drug his daughter behind the car to teach her a lesson, don't know his status but this next one was an illegal, while back a man drug his wife or girl friend for blocks until she was dead!! Unbelievable sick people!!
