PROVIDENCE, R.I. -- A bail hearing for the man accused of killing a police detective was postponed Monday because his Massachusetts lawyers have not found a local attorney who will work on the case.
Kirsten Wenge, one of the Boston lawyers representing Esteban Carpio, said she and Robert Sheketoff have contacted several dozen Rhode Island lawyers but none have agreed to take the case. She declined to speculate on why, but said she was surprised at how difficult it's been to try to find a Rhode Island attorney to work on the case.
Carpio, 26, is accused of fatally shooting Providence police Detective Sgt. James Allen last month with the officer's own gun while being questioned at police headquarters. Carpio then allegedly fled by jumping out of a third-story window; he was caught after a chase and a scuffle with police.
Carpio, who has appeared in court with a plastic spit shield over a badly bruised face, appeared for court Monday by videoconference, wearing a white covering over his chin and mouth.
Joy Fox, a spokeswoman for the Department of Corrections, said the device is known as a spit hood, and said Carpio now wears it any time he is outside his cell. The hood is made from soft material, principally a form of elasticized gauze, Fox said.
Carpio had to wear the hood during the hearing to protect the others in the room, Fox said.
"Unfortunately, he has shown a history of being unpredictable," she said.
During the hearing, Carpio complained that he hasn't seen his family since his arrest last month and asked to visit with them by videoconference. District Judge Elaine Bucci rejected his requests.
A hearing was scheduled for June 20 to determine if a Rhode Island lawyer has been named to the case.
Bucci told Carpio if his lawyers can find in-state counsel sooner, she will meet with them then.
Bucci asked Carpio Monday if he wanted a court-appointed attorney.
He said he would defer to his family's wishes, and agreed to wait until June.
"I'm trying to find out if I can get some kind of bail as soon as possible, but if that's what it takes, then, fine, ma'am," he told Bucci.FAR BEYOND DRIVEN
