Immigrant jailed for attack on federal agent, vowing he won't go home

(Houston) -- He was ordered to leave the country for a lengthy list of crimes, and agents say he had no intention of going quietly when they arrived at his Houston home to arrest him.

Ghouchou Khaba, 39, was living in his home off Eldridge Parkway just west of Houston when Immigration & Customs Enforcement agents came looking for him in June. He got away after a violent struggle but he was captured and faced a Houston federal judge this week.

In their arrest warrant affidavit, ICE agents write that they pretended to be interested in buying a car in Kaba's driveway and he walked out to greet them. When they flashed their badges, he claimed agents had the wrong guy.

He asked to go inside his home to show them his identification when agents say he broke away from them and started fighting both agents.

The agents grabbed him and followed him into the home, and they write that family members were yelling and screaming at them during the entire scuffle, even trying to block the agents from moving at times. At one point, Kaba yelled, "You have 5 seconds to get out or else."

He broke free, with the help of family members, and Harris County Sheriff's K-9 and air patrol responded to wage a manhunt. He was not found.

Agents write that they were especially worried about him yelling they had 5 seconds to leave "or else" because weapons were part of the reason they were there to begin with.

The reason he was ordered out of the country in 2004 is a lengthy criminal record, including guns.

He served 60-days in jail in California in 1994 for carrying a concealed weapon in his car in a school zone, and then he served 3-years in a California prison for Grand Theft of property over $400.

That's when ICE started proceedings to remove him from the United States. He had arrived in the US in 1990 on a visitor visa and was then granted asylum status in the US.

He was convicted in April 2009 for marijuana possession after Houston Police caught him with pot, even after ICE started proceedings to remove him.

After the scuffle and the fruitless manhunt, ICE agents say he called them to say he was not going back to Liberia and he was fleeing to the east coast to avoid being arrested.

He was arraigned before a federal magistrate on the federal assault charge this week. Now he faces a federal prison sentence, after which he will be removed from the country.
