    Who exactly is refusing to follow the law?


    Dear John,

    A group of 10 ICE agents and officers, led by ICE Council president Chris Crane, have filed suit against DHS Secretary Janet Napolitano and ICE Director John Morton seeking an injunction against the Napolitano Directive of June 15, 2012, to give approximately 1.7 million work permits to illegal aliens so they can compete for U.S. jobs.

    CNN had a funny way of reporting the story: "In a nutshell, the agents -- one of whom is the president of the ICE Agents and Officers Union -- do not want to obey the new policies and do not want to face any disciplinary actions or lawsuits if they continue to arrest any type of immigrant who is in the United States illegally."

    P.S. A little background: On June 17, 2012, an illegal alien who was arrested for assault attempted to escape during a routine jail check and injured an ICE officer in the process. But once the suspect was captured, ICE managers ordered that he immediately be released in accordance with the President's new immigration polices.

    (KUTV) "ICE' agents may provide heat for the Obama Administration over immigration policy, and a Utah man is a central figure in the fight.

    "We're being ordered to follow what we believe are unlawful orders," Chris Crane, an Immigration and Customs Enforcement agent in Utah told 2News, after he and nine other ICE workers filed a lawsuit against Homeland Security Secretary Janet Napolitano, and ICE Director John Morton.

    The agents have taken aim at a new "directive" from the Obama Administration that bans the immediate deportations of many students, whose parents illegally brought them into the country.

    To keep deportation proceedings at bay, the students would have to show they arrived in the U.S. before they were 16, have continuously lived in the U.S. for at least five years, have met education or military service requirements, and have little or no criminal history.

    But Crane and others maintain the directive is unconstitutional, and "commands ICE officers to violate federal law."

    "We're actually releasing people that we shouldn't be releasing to the public, people in the past who we would not have released," said Crane.

    His words may carry clout. Aside from his duties as an ICE deportation officer, Crane also serves as president of the ICE Agents and Officers Union, AFGE Council #118, a union that claims to represent more than seven thousand Immigration and Customs Enforcement workers.

    More than a week ago, 2News spoke to a young woman in the Salt Lake area who said she would benefit from the directive.

    "I've been in the United States for 16 consecutive years," said Sol Jimenez, who was illegally brought to the country when she was just two years old.

    Jimenez said she graduated from high school, and is planning to further her education. "Now I'm starting at the University of Utah, hoping to double major in political science and journalism."

    Still, according to the suit, federal law states an "alien shall be detained" if an "immigration officer determines that an alien seeking admission is not clearly and beyond a doubt entitled to be admitted" to the country.

    The suit seeks to block the government from implementing or enforcing the new directive.
