Man sentenced to 20 years under new sex offender law

PELL CITY — An illegal immigrant pleaded guilty to first-degree rape Thursday and was sentenced to 20 years in prison under a new, tougher sex offender law passed by the state Legislature last year.
St. Clair County District Attorney Richard Minor said Cesar Serafico, 28, was the first person prosecuted in St. Clair County under the Sex Offender Registration and Community Notification Act passed in 2005.

Under a plea agreement, St. Clair County Circuit Court Judge Charles Robinson sentenced Serafico Thursday to serve 20 years in prison, the mandatory minimum sentence for the rape of a child under that age of 12.

Minor said under the new law, Serafico will serve the entire 20-year sentence.

“He is not eligible for probation, a split sentence, early release or parole,” Minor said. “He will serve 20 years with the Department of Corrections.”

Serafico was arrested in April and charged with the first-degree rape of an 8-year-old girl. He has remained in custody at the St. Clair County Jail without bond since his arrest.

“I commend Detective Josh Herring and the Pell City Police Department for their quick response and investigation that resulted in the conviction today of a child predator,” Minor said.

Under the new law, Serafico could be electronically monitored for up to 10 years after his release from prison.

However, Minor said he anticipates Serafico will be deported back to Mexico when he is released from state prison.
