Indiana Senate to Have Floor Vote Today on E-Verify
Tuesday, February 24, 2009, 7:50 AM

A vote of State Senate passage of Sen. Mike Delph’s (SB 580) strong illegal immigration crackdown bill is set for today. The bill had passed committee on Feb. 18 with some objectionable changes but Senators amended the bill on the floor yesterday to remove some bad provisions. If you live in Indiana, please call and email your Senator as soon as possible to ask for passage of SB 580 without any further weakening amendments.

The proposed legislation would prohibit employers from knowingly employing illegal aliens and would require state and local governments, and their contractors, to use the federal E-Verify system to check the employment eligibility of new hires.

Some private employers also would be required to use E-Verify under the bill, but most would be subject to an administrative complaint process (individuals could file complaints with the state attorney general) that could lead to a business-license suspension or revocation for those found to have knowingly hired illegal aliens. Companies that use E-Verify, however, are provided safe harbor against such administrative actions. The bill also bans sanctuary policies, requires state correctional facilities to check the immigration status of inmates, and mandates the use of the federal Systematic Alien Verification for Entitlements (SAVE) system to verify eligibility for public benefits.
