    Judge blocks Alabama immigration rule linked to mobile homes

    BIRMINGHAM, Ala (Reuters) - A federal judge temporarily blocked a part of Alabama's tough new immigration law on Monday that requires residents to show proof of citizenship when registering mobile homes with the state.

    U.S. District Judge Myron Thompson of the Middle District of Alabama wrote in court papers that state officials were preliminarily barred from requiring anyone trying to pay an annual registration fee for mobile homes "to prove his or her U.S. citizenship or lawful immigration status."

    The ruling comes in response to a lawsuit filed by two unnamed Alabama residents, with assistance from fair housing groups.

    If I'm not mistaken, aren't mobile homes classified as automobiles and subject to the same rules as cars?

    Does this mean no one needs to prove legal status to register cars in AL?
    Does it also mean now that anyone (with legal status) who was required to show docs to register their cars in AL can sue the state for discrimination?

    Ahh cool, so now I can avoid laws and rules for my car by simply having a suitcase of cloths and a camping gas burner in my car saying its my "mobile home".....

    MONTGOMERY, Ala. — A federal judge on Monday blocked a provision of Alabama's immigration law that could have forced illegal immigrants to leave their mobile homes because they couldn't renew the registrations needed to live there.

    U.S. District Judge Myron Thompson issued the preliminary injunction to replace a temporary ruling in effect for two weeks. He said there was substantial evidence that "discriminatory bias against Hispanics" motivated the Legislature's passage of the law, but he reserved a final ruling until later.

    One of the provisions of Alabama's new immigration law requires mobile home occupants to prove their legal residency when they go to the county courthouse to secure their annual mobile home registrations. Several groups challenged that portion of the law in federal court in Montgomery, and Thompson put the requirement on hold temporarily before the renewal deadline for the registrations passed Nov. 30.

    In a 108-page opinion Monday, the judge said the opponents are likely to prevail on their claims that the residency requirement conflicts with federal laws.

    "Everyone can go get their mobile home decal now," said Sam Brooke, attorney with the Southern Poverty Law Center in Montgomery.

    State Attorney General Luther Strange, who's defending the law, had no immediate comment, a spokeswoman said.

    In Thompson's ruling, he said the effect of the state's immigration law "falls disproportionately upon Latinos" and the legislative debate about it "was laced with derogatory comments about Hispanics."

    He recounted one legislator talking about 30 Hispanics getting out of a car and comparing it to a crowded clown car in the circus. Another, he said, talked about visiting a poultry plant and seeing "4-foot Mexicans in there catching them chickens."

    Foster Maer, attorney for LatinoJustice, said the court saw the law for what is — "an attack on the ability of Latino and other immigrants to stay in their homes as if they are causing our economic problems."

    The case before Thompson in Montgomery is separate from a suit in federal court in Birmingham that has resulted in some other provisions of the law being put on hold.

    Mobile home (house trailers) don't have motors so they have some different rules than cars. RVs with motors have rules more like cars and trucks. Travel trailers have their own rules too, in most places. Years ago in Florida if your mobile home had wheels on it, even if it was up on blocks it had to have a license plate on it. But if it was up on blocks and you took the wheels off it didn't need a license plate. I don't know if it's still like that there or not.

    Fair housing groups my arse. Will they sue the Hispanic that speaks no English that won't rent to anyone but Spanish speaking families?
