    Judge orders feds to release Chinese Muslims from Gitmo, let them enter USA

    This just in from the Associated Press: A federal judge ruled this morning that the U.S. government must release a group of Chinese Muslim prisoners from Guantanamo Bay, Cuba, and allow them to enter the United States since they're no longer deemed "enemy combatants."

    "They have been in custody for almost seven years and have been cleared for release since 2004. Although the Chinese government has demanded custody of the Uighurs, supporters and the Bush administration fear they would be tortured if turned over to Beijing," the wire service says.

    AP describes this as a "landmark decision."

    Judge orders Chinese Muslims into U.S. from Gitmo

    WASHINGTON (AP) — A federal judge has ordered the release of a small group of Chinese Muslims from Guantanamo Bay into the United States.
    In a landmark decision, U.S. District Judge Ricardo M. Urbina said it would be wrong for the Bush administration to continue holding the detainees, known as Uighurs since they are no longer considered enemy combatants.

    They have been in custody for almost seven years and have been cleared for release since 2004. Although the Chinese government has demanded custody of the Uighurs, supporters and the Bush administration fear they would be tortured if turned over to Beijing.

    On Tuesday, Urbina called the detention unlawful saying the Constitution prohibits indefinite imprisonment without charges.

    The Uighurs have been at Guantanamo Bay since the U.S. military took custody of them in Pakistan and Afghanistan in 2001. Efforts by the Bush administration to find a home for the detainees has been complicated by fears in many countries of diplomatic reprisals by China.

    Statement of Brian Roehrkasse, Director of Public Affairs, on Today’s District Court Decision Ordering Release of the Uighurs Detained at Guantanamo Bay

    “Today, the U.S. District Court for the District of Columbia ordered that 17 Uighurs detained at Guantanamo Bay— individuals who have admitted to receiving weapons training at camps in Afghanistan— be released into the United States. Today’s ruling presents serious national security and separation of powers concerns and raises unprecedented legal issues.

    “The government advised the court in its submissions that these Uighurs were captured near Tora Bora by the United States and its allies following military operations against al Qaeda and the Taliban, that the Uighurs were receiving weapons training in Taliban-controlled Afghanistan at the time of the Sept. 11, 2001 attacks, and that, although the United States no longer treats these Uighurs as ‘enemy combatants’ of the United States and has been seeking to transfer them out of Guantanamo Bay and to appropriate foreign countries willing to accept them, the government does not believe that it is appropriate to have these foreign nationals removed from government custody and released into the United States.

    “Following today’s ruling, the government moved to stay the decision to enable the government to consider its appeal options and to consider how such a release might be effected. The court denied the motion, and ordered the government to bring the 17 Uighurs from Guantanamo Bay to the court in Washington, D.C., by Friday, October 10. The court also set a hearing for Thursday, October 16, to determine the conditions of release and ordered that an official of the Department of Homeland Security be present. During the time between the presentment of the Uighurs on October 10 and the hearing on October 16, the court ordered that the government have no supervision or oversight of the released individuals.

    “In response to today’s ruling, we are filing an emergency motion for stay pending appeal tonight with the U.S. Court of Appeals for the D.C. Circuit.

    Judge, you house em then if you want them on US Soil. they are in gitmo for a reason and if you have a problem with that, then why dont you go take them to China yourself and stay there with them.
    I DO NOT WANT anyone from GITMO on AMERICAN SOIL and im sure i speak for almost all americans

    "they are no longer considered enemy combatants" Since when did American authorities start forgiving people that want to blow up Americans and our country? IMO they are even more po'd than ever before and are more of a threat to the U.S. because they were held prisoners for 7 years.
