A state can cut off food stamps to most legal immigrants, a federal appeals court ruled Wednesday in a case that potentially affects California and a small number of other states that extend the nutritional program to noncitizens.
California, however, has not sought to eliminate its funding of food stamps for immigrants ineligible for the federal program. The ruling by the Ninth U.S. Circuit Court of Appeals allows Washington state to implement a cutoff that a federal judge had blocked a year ago.
Food stamps were established by a 1964 federal law that covered all low-income households, with the federal government paying all food costs and splitting administrative expenses with the states.
A 1996 law denied food stamps to legal immigrants who were not yet U.S. citizens, except for those who have lived in the United States for at least five years and a few other categories, including victims of domestic violence. A 2003 law restored eligibility to immigrant children.
The law did not prohibit states from using their own funds to provide food stamps for immigrants ineligible for federal aid. As of November 2010, the court said, seven states were making that aid available, including Washington and California.
But in February 2011, Washington Gov. Christine Gregoire ordered elimination of food stamps for 14,350 legal immigrants. A federal judge blocked the cutoff, saying it was likely to be ruled an unconstitutional act of discrimination based on citizenship status, but the appeals court disagreed.
The federal government acted legally when it withdrew funding for immigrants' food stamps in 1996, and states have no obligation to fill the gap, the court said in a 3-0 ruling.
"States constitutionally can do precisely what Washington did here: provide supplemental benefits when the state's coffers bulge, but eliminate them when the state's resources diminish," the court said.

Another Law that SHOULD be Mandatory Nation Wide
This is ANOTHER "Common Sense" law..Common Sense tells anyone with SENSE, that Illegals and NON-citizens, Are NOT and Should NOT qualify for Programs designed to assist NEEDY AMERICANS..these programs were NEVER meant for use by NON-Americans..Thats why funding is drained and now there are MORE Needy Americans suffering than EVER!!, Being told they have to WAIT or Cant Qualify..WHY? Because these NON-Americans are snatching, Fraudulently all the assistance!
Imagine How much taxpayer money could be saved by Mandating this law across America...And imagine How FEWER Hungry Americans we would have living in Poverty, because then the assistance could help those who Rightfully belong here!

Most illegals, however, receive food stamps for the family on behalf of their U.S. born children, who will not be cut off due to their status as "citizens".

Which is why we so desperately need to stop the damned anchor baby thing!!!!! These people are notorious for having large families and costs us plenty!!!!! Not to mention all the fraud going on where many illegal wome claim they are a one income household when they are not. With their combined incomes they are well above poverty limit and have no business recieving benefits!!!!!!!!
