    Why Washington AG Bob Ferguson doesn’t expect DACA protections to be rolled back

    Bob Ferguson — the Washington state attorney general who gained notoriety in the tech community by enlisting business to take on President Donald Trump — is optimistic about his latest stand on immigration.


    Speaking at the 2017 GeekWire Summit, Ferguson said he doesn’t expect Trump’s repeal of the Deferred Action for Childhood Arrivals (DACA) program to go through.


    In September, the Trump administration ordered an end to the Obama-era program that protects immigrants who came to the U.S. illegally as children from deportation and allows them to study and work here. The president urged Congress to act by March otherwise some 800,000 “Dreamers” protected by the program would be eligible for deportation.


    “What they said was, ‘DACA itself is illegal, therefore Congress has to act or we’re going to let it run its course,'” Ferguson said on-stage at the GeekWire Summit last week. “There’s just one problem saying DACA is illegal. No courts ever reached that decision. I mean, not one. Us lawyers care about these details.”

    “Are any of these cases easy? Of course not,” Ferguson said. “These are complicated, complicated cases. But I’m optimistic with our lawsuit or I would not have filed it.”


    In the weeks following Trump’s DACA announcement, tech leaders have come out in support of Dreamers. Facebook CEO Mark Zuckerberg said, “it is particularly cruel to offer young people the American Dream, encourage them to come out of the shadows and trust our government, and then punish them for it,” in a Facebook post.


    Microsoft President Brad Smith said the federal government would “have to go through us” to deport employees protected by DACA. He reiterated that sentiment in another interview at the GeekWire Summit this week.



    Ferguson said he is also optimistic about his lawsuit because of public support for DACA.


    “Within the contentious area of immigration, where there are strong views on both sides, DACA is wildly popular,” he said. “I’ve seen upwards of 80 percent of Americans support it, with good reason. These are individuals who came to our country as children through no fault of their own. Why on earth would we deport them to a country they don’t know? It makes no sense.”

    So we recently read DACA is dead but now we read DACA could be very alive through judicial challenges. The response on DACA from the White House voices has been rather wishy washy.

    President Trump should have left the door on DACA slammed shut with Attorney General Sessions' statement on the program. The words of a possibility to revisit DACA, whether or not the intention, should have never been spoken or hinted at. It probably would not have impacted court challenges but a stronger support for the Justice Dept. Ruling to end DACA would have been a better decision in my opinion.

    Hmm, still living in denial I see. DACA is not dead until it's breathed it's last breath and that certainly hasn't happened yet. No more renewals or applications doesn't mean the program is dead, it only means no more renewals (at this time) or applications. As long as illegals are still protected by the program, it's very much alive.

    All the above will become moot should Trump get the legislative solution (amnesty) he desires.

    Please do not post false information here Judy. DACA is not dead and the program continues for more than 800,000 illegal aliens that enjoy all protections and priveledges of the illegal program this very day.

    Only with the door already shut on the program is it clear just how big the DACA population really is: about 690,000. And that number is about to start shrinking — maybe as soon as in the next days or weeks.
    Immigrants whose current DACA grants expire before March 5 had to have their renewal applications submitted before Thursday, October 5 — and as of the eve of the deadline, as many as 42,500 hadn’t done so yet. Some applications probably came in at the last minute, but it’s plausible that tens of thousands of immigrants missed the cutoff and will simply lose their DACA once the current grants expire. (This is especially likely for immigrants who are set to lose DACA in January or February of next year.)
    In the meantime, DHS isn’t obligated to approve any of the 115,000 or more applications for renewal it has gotten. In fact, one of the biggest criticisms of DACA, and the biggest argument for its unconstitutionality, was that immigration officers hadn’t had enough discretion to reject immigrants who qualified for the program on paper. And the ACLU is arguing that the Trump administration has unfairly stripped people of existing DACA protections — which doesn’t bode well for how its agents will treat applications for renewal.

    So if I'm reading this correctly there will possibly be 196, 511 renewals approved between now and March 5th? If that's true and you add the 690, 000 to it, you get 886, 511. So the actual number of 690,000 provided by the Trump administration is actually set to increase between now and March 5th, not decrease.

    Is someone attempting to make us think there will be less folks amnestied than originally thought? Are they maybe thinking that will make an amnesty more acceptable?

    So is the VOX article information Judy provided inaccurate or am I missing something? Whatever the case, DACA lives on until replaced by legislation or March 2020.
