Immigration crackdown endorsed by Senate committee
By Dan McFeely
dan.mcfeely@indystar.com
After nearly three hours of passionate and often emotional testimony from Hispanics, legal scholars and lobbyists for Indiana business leaders, a Senate committee voted 10-1 to pass a tough new illegal immigration bill that penalizes employers who hire illegal immigrants.
Senate Bill 335 -- which now moves to the full Indiana Senate for consideration -- has been labeled as "unfriendly" to the Hispanic community, many of whom believe it could lead to racial profiling, innocent victims and possibly a mass departure of workers, both legal and illegal.
The bill was opposed by lobbyists for the state and city chambers of commerce, the restaurant industry, manufacturers, Hispanic activists and a lobbyist for the Catholic Church. But legislators have said they are hearing from their constituents who say illegal immigrants are a drain on their tax dollars, a channel for illegal drugs and a matter of national security.
"This bill is not intended to be racist or to drive people out of our country," said Sen. Jim Arnold, D-LaPorte, who voted for the bill. "It is designed to be a welcoming bill" for those who want to come here legally.
But Sen. Greg Walker, R-Columbus, cast the only vote against the bill and said he read the 14th Amendment to the U.S. Constitution "about 12 times today" and believes Indiana is entering dangerous waters by passing an unconstitutional law.
"I am not prepared today to require that the state of Indiana secede from the State of the Union."
The bill, authored by Sen. Mike Delph, R-Carmel, calls for stiff penalties against employers who hire illegal immigrants, punishing them in a series of steps that could ultimately lead to revoking their business license. It calls for the state attorney general's office and local prosecutors to investigate written complains about such activity. The bill also makes it a criminal act to transport or aide an illegal immigrant.
This morning, an amendment was approved to push back the effective date from July 1, 2009 to Oct. 1, 2009 and more exemptions from prosecution were added, including churches, healthcare workers, attorneys and spouses, parents and children of suspected illegal immigrants.
The bill was modeled after similar legislation in Arizona and Oklahoma, both of which are undergoing constitutional challenges. Today's testimony included national perspectives from a New Jersey constitutional attorney, Louis R. Moffa Jr., who is one of the lead attorneys in the challenge of the Arizona law; and Mike Cutler of New York, a former INS officer who testifies frequently on immigration law issues on behalf of tougher regulations. Both flew in to Indianapolis today to give testimony.
More than 50 people signed up to testify today, but the committee chairman Dennis Kruse, R-Auburn, cut off testimony at 1 p.m. for a vote. Delph vowed to meet with those who did not get to speak immediately after adjournment.

Unconstitutional?????? TN has had a law for years that states you lose your license by employing illegals. Of course, it hasn't been enforced. A business license allows people to operate under certain conditions and hiring legal workers is just one of those. I am sick of hearing "unconstitutional" everytime a law is enforced or enacted. It's getting absurd. They just hope for some leftist judge to interpret it their way.
The protesting of the Chamber, manufacturers, restaurants, etc. just shows you how many of these people are hiring illegals and they know it. They hire them for two reasons......1. They will work below minimum wage and 2. They will do anything they are told and for as long as they are told to. You can't get much closer to slavery without actually chaining people.

.Way to go Indiana !!
It's refreshing to see more and more states standing up to do what is right for Americans and those legally here instead of listening to the rantings of special interest groups and hispanic illegal aliens crying about racism, hardship etc.
It should be becoming very clear to them that they've long ago outplayed the race card and their "warnings" about what might happen no longer are effective.
This morning, an amendment was approved to push back the effective date from July 1, 2009 to Oct. 1, 2009 and more exemptions from prosecution were added, including churches, healthcare workers, attorneys and spouses, parents and children of suspected illegal immigrants
Exemptions from what? The act of transporting and aiding an illegal immigrant?
I'm sorry, but with the exception of minor children and health care providers, there should be no one exempt from the law. Churches are making careers out of transporting and hiding these people, enabling them to break the law and openly encouraging them to do so. It's time they are held criminally liable for this. And family members should be as well. How many of them are assisting in arrivals, obtaining false documents, stolen identities, and jobs using those things. How many are teaching the new arrivals how to perpetrate any number of crimes and assisting them in doing so. How many are hiding fugitives from deportation orders and other crimes.
No, the families are probably the biggest culprits going and they need to start being held accountable as well.Join our efforts to Secure America's Borders and End Illegal Immigration by Joining ALIPAC's E-Mail Alerts network (CLICK HERE)

VIOLATION of social security laws by employers involving 5 or more employees is 250,ooo fine and up to 15 years in jail .There is also no excuse some form of E-verify has been around sice 1996-NO EXCUSES,NOEXCUSES NO EXCUSES!WE DO NOT NEED NEW LAWS,IT is unbelievable the amount of fines and laws on the books.Did you know that if a raid is conducted at a construction site for example all the bulldozers, dump trucks etc that they even think illegals have been using can be sold at public auction?Enforce and have just a couple of auctions and they number of businesses using e-verify will burst and thay will stop hiring illegal aliens!

Excellent. Since Sen. Walker is an expert on the 14th Amendment, perhaps he can explain where in the 14th amendment it states that children born to two illegal invaders, here in violation of US Law are entitled to automatic citizenship.
It would seem to me that two persons here in violation of law are not subject to the "jusridiction thereof" this United States.
I'm certain Sen. Walker has a different interpretation of the 14th amendment. I would love to hear it.Join our efforts to Secure America's Borders and End Illegal Immigration by Joining ALIPAC's E-Mail Alerts network (CLICK HERE)
