"Sanctuary City" Challenged

A line has been drawn in the sand between the city of Lexington and a handful
of taxpayers who say enough is enough when it comes to providing social services to illegal immigrants.

WTVQ first told you about the claim the was filed in court this summer to get a federal ruling that would compel the city of Lexington to comply with federal immigration laws.

The claim says the city is violating federal immigration law by providing social services to people who may be living here illegally.

The Urban County Government and the Health Department are asking the court to dismiss the claim against them because one of the men filing it, David Duncan, does not have standing to bring a lawsuit against the government.

The city attorney also argues that the federal courts do not have jurisdiction over this type of claim.

Duncan says the city's response to the filing is sending a message that lexington is a sanctuary city, which means it's a place known to provide benefits like health care and food stamps without verifying eligibility.
