Our Governor supports those “Hands Off� policies by our law enforcement. She vetoed a bill that made it clear they could and should assist in the enforcement of our immigration laws as 1996 federal law intended.

    "These cities with their sanctuary laws and the federal government are co-conspirators in that they won't enforce the law. There are over 4,000 murder warrants out, just in the Border States, for people who've committed murder and fled to Mexico. You wonder how many more people have to die..."

    By Ben Fox THE ASSOCIATED PRESS April 25, 2005 Rep. Russell Pearce, a Mesa Republican, said many communities have "outrageous" policies that mean people who are in this country illegally need not fear police.

    Tucson Police Department, whose spokesman has said the force has too many other crimes to fight instead, and it doesn't want crime victims to be afraid they'll be turned over to the U.S. Border Patrol if they call local police. (How we love to twist the truth).

    SANTA ANA, Calif. - Frustrated by illegal immigrant criminals who slip through their grasp, a growing number of state and county police agencies nationwide are moving to join a federal program that enlists local officers to enforce immigration laws.

    The U.S. government has already granted that authority in Florida and Alabama, and the program is under consideration in Connecticut, Oklahoma and Arkansas.

    To the dismay of immigrant advocates, it's also in the works in Southern California - one of the nation's most ethnically diverse regions, where it would reverse a long-standing policy of avoiding questions about immigration status during local criminal investigations.

    April 1st, 2005 a landmark decision by The Supreme Court Razes Any Artificial Fire Wall between Local Law Enforcement and Immigration Enforcement. "Whatever legal fig leaf many police departments have been using to justify policies of non-cooperation with federal immigration authorities, has been stripped away by this landmark Supreme Court decision, "If local police are barred from cooperating with federal authorities in the enforcement of U.S. immigration laws it is purely a political decision on the part of local politicians and police chiefs. There is no legal barrier to local police inquiring about a person’s immigration status and then acting upon the information they gather."

    Local law enforcement agencies lost an important tool in the fight against crime and residents remain at great risk with Gov. Janet Napolitano’s veto of a measure that allowed police to arrest illegal aliens.

    Despite widespread support Napolitano vetoed SB1306, a measure crafted by me to give local law enforcement the ability to enforce these laws.

    “This veto represents yet another way for Janet Napolitano to pander to illegal aliens,� Pearce, R-Mesa, said. “She has repeatedly quashed any attempt at real efforts to stem the tide of illegal immigration and its negative effects. Whatever legal fig leaf this Governor and local politicians have been using to justify policies of non-cooperation with federal immigration authorities, has been stripped away by a recent Supreme Court landmark decision."

    SB1306 made it clear that law enforcement agencies may detain a person discovered to be an illegal alien and then transport the illegal alien to a detention facility.

    This common-sense approach would give law enforcement a big tool in the fight against crime, Pearce said. According to both federal and local law enforcement agencies, so many of the criminal organizations that have sprouted in the southwest count illegal aliens among their ranks. But our police are almost powerless to stop the spread of this crime spree because they cannot ask simple questions that would ensnare the criminals, Pearce said.

    Similar movements are afoot across the country. In Orange County, Ca., wants to train 500 to detect and catch illegal aliens, particularly those who run with dangerous gangs such as MS-13 now in more than 33 major cities.

    Pearce said. “Some are finally recognizing the correlation between getting illegal aliens off the streets and lower crime rates. Arizona should follow.�

    Since Gov. Napolitano refuses to allow law enforcement to do their #1 job protect our neighborhoods from criminal/violent aliens, it may be time for the people of Arizona to override her veto.

    I will work to bring this issue to the ballot to let the voters of Arizona have their say. And I believe that just like Proposition 200, the voters of this state will show their serious concerns for illegal immigration by making it clear that local police have the ability to detain illegal aliens.

    "With 23 million illegal aliens in the U.S. we must unleash or most effective tool the beat cop. We have 600,000 police officers patroling the streets of America. We must take of the handcuffs that bind their ability to catch criminals, citizens must be able to rely on the most effective tool we have in the fight on this illegal alien invasion:" Pearce said. And that also has to be done by taking away incentives such as providing benefits to illegals and giving them sanctuary in our cities (at a cost of over 69 Billion annually in government services).

    Allowing police to enforce immigration laws is a giant leap forward. Next year, Pearce said he will work to put this important policy decision in front of voters to tell both Napolitano and illegals what the citizens of Arizona really want.

    “We must recognize that the laws of this country are being violated every day,� Pearce said. And every day that goes by, we lose control of this country. The time to take back control is now.�

    Now that we recognize the law and the Supreme Court has decided it’s constitutional, isn’t it about time we use our local police force to enforce immigration law?

    This is why I have worked so fervently to give our state and local police the ability to determine the residency status of suspects. By uncuffing our police, we add a new layer to border enforcement.

    This new law, which was vetoed by this Pro-Illegal Alien Gov. Janet Napolitano, is critical if we are serious about this illegal alien invasion; the crime and economic impact that comes with it.

    If they really want to help instead of $1 billion of tax dollars to reimburse hospitals a partial cost of illegal aliens taxpayer medical benefits, they need to invest it in border security.

    Our Governor can no longer hide behind “this is a Federal problem� and say she can do nothing about.

    Again, with a friend of the illegal alien sitting in the governor’s chair, this will have to taken to the people of Arizona for these common sense tools to ever be used.

    Could the reason for this be that neither our government nor those ignoring the Constitution, massive entry and open border policies wish to be bound by the proper limits that protect our nation and rights, but would pursue their own greedy interests above national and societal well-being.

    ILLEGAL IMMIGRATION: Amnesty: Winning the Jackpot for Breaking the Law! 26 million “illegal� aliens in the United States today, we need enforcement not reform!

    We allow 1.4 million “legal� immigrants into the United States every year, but we cannot allow this mass “illegal� entry of 3 to 5 million each year to this nation.

    We should encourage legal immigration and always discourage illegal immigration, yet this Governor continues to encourage “illegal� entry by fight every effort to stop welfare fraud, voting fraud, (fought against Prop. 200, even after it passed with a large majority), and vetoes any meaningful legislation to discourage illegal immigration. We need elected officials who are willing to speak clearly for legal immigration and speak clearly against illegal immigration.

    Illegal Aliens cost taxpayers $69 Billion annually (just in social services) in federal programs in 2002. Studies estimate that amnesty would increase that three fold. $311 Billion in uncollected taxes, due to the underground workforce (Barron's study). $200 Billion annually in-lost American wages. Native-born American men lost an average of $1700 in wages in 2000 due to US immigration policy (Harvard University). Maricopa County Hospital loses over $2 million weekly on uncompensated care (largely do to illegal aliens) (2003, 77 border hospitals filed for bankruptcy). Feds owe $25 million in uncompensated SCAAP costs just in Maricopa County,

    1/3 of our federal prisons are illegal aliens). Arizona spends over $800 million (K –12) annually to educate illegals.

    Over half of AHCCCS births are from illegal mothers 1/3 of children in Arizona have immigrant parents. "The United States shall guarantee to every State in this Union a Republican form of Government, and shall protect each of them against invasion." Article IV Section 4 of the U.S. Constitution. Today, the majority of these elected officials are in violation of their oath of office, with severe consequences to their law abiding U.S. citizen constituents’.

    I want you to know how I reverence the Constitution; this sacred document given to us by God through the Founders that sought inspiration as they forged this inspired document.

    THE LAW: Federal Immigration and Nationality Act Section 8 USC 1324(a)(1)(A)(iv)(b)(iii) "Any person who . . . encourages or induces an alien to . . . reside . . . knowing or in reckless disregard of the fact that such . . . residence is . . . in violation of law, shall be punished as provided . . . for each alien in respect to whom such a violation occurs . . . fined under title 18. . Imprisoned not more than 5 years, or both." Section 274 felonies under the federal Immigration and Nationality Act, INA 274A(a)(1)(A):

    Enforcement: …State and local law enforcement officials have the general power to investigate and arrest violators of federal immigration statutes without prior INS knowledge or approval, as long as they are authorized to do so by state law. There is no extant federal limitation on this authority... The 1996 immigration control legislation passed by Congress was intended to encourage states and local agencies to participate in the process of enforcing federal immigration laws…with 23 million illegals in the U.S. it is critical that we use local law enforcement. That is what we pay them to do. It would be much cheaper in the short run and certainly in the long run.

    The Constitution: "The United States shall guarantee to every State in this Union a Republican of Government, and shall protect each of them against Invasion" [ Article 4, Section 4 http://www.usconstitution.com/Read.htm ] U.S.C. -- TITLE 8, Sec. 1103 (Powers and Duties of the U.S. Attorney General): (1) The Attorney General shall be charged with the administration and enforcement of this chapter and all other laws relating to the immigration and naturalization of aliens... (5) He shall have the power and duty to control and guard the boundaries and borders of the United States against the illegal entry of aliens and shall, in his discretion, appoint for that purpose such number of employees of the Service as to him shall appear necessary and proper. “Until the day I die, I will insist that 'illegal' is 'illegal'." To call an “illegal� alien an undocumented immigrant is to call a burglar “key� deficient.

    The people's republic of Arizona needs to vote this stooge out of office. She is a disgrace. Arizonians need to remember all of her misdeeds when it comes time to vote next year.
