Lead immigration case plaintiff jailed on child porn charge

Hazleton man who was the lead plaintiff in a case that challenged the city’s illegal immigration law will go to prison for downloading child pornography again.


Pedro Lozano, 64, listed in court documents as Pedro Pablo Lozano-Gomez, was sentenced Monday for disseminating depictions of children engaged in sexual acts and the criminal use of a communication facility. He will be in Luzerne County Correctional Facility for four to 23 months.


The sentence is concurrent with another sentence he is serving. Gomez downloaded child pornography on Jan. 8, 2013, and again on Jan. 29 of that same year, according to court documents. Police charged him separately in those cases.


Lozano is not allowed access to the Internet, unsupervised contact with minors and must register as a sexual offender for life. He will also be on probation for two years after his prison sentence and must undergo sexual offender treatment.


Lozano was a lead plaintiff in a case that became known as Lozano v. Hazleton, which challenged the constitutionality of Hazleton’s illegal immigration law. The law would have punished landlords for renting to illegal immigrants and sanction businesses who hired them.


The U.S. Court of Appeals for the Third Circuit in Philadelphia ruled that the law was unconstitutional in July 2013.
