Local View: Nebraska's AG's office always fights discrimination

The interaction between my office and the Nebraska Equal Opportunity Commission (NEOC) has been in the news lately, but it seems the facts are in short supply. The bottom line in all of this is that this office will always prosecute those who discriminate.
The Journal Star’s May 2, 2008, article said that Vince Powers’ law firm intended to sue me for not filing cases. [b]I was not asked if I wanted to defend myself, nor were the “factsâ€If your ILLEGAL...get out of my country...get out of my state...get out of my community...get out of my face!...otherwise, have a nice day!

Attorney General Jon Bruning repeatedly has chosen not to enforce Nebraska fair housing laws during the term of his office. His May 8 Point of View opinion piece deliberately failed to inform the readers that three other law firms in addition to Kathleen Neary of my office have offered to represent the Nebraska Equal Opportunity Commission for free.
The many lawyers who have volunteered have done so because the attorney general is making a mockery of Nebraska’s proud reputation of fairness for all.
Because there would be no fee charged to the agency, neither the attorney general nor the governor need approve such a hiring. One does not need to be a lawyer or a member of a political party to interpret the following law of the Sate of Nebraska to which Bruning swore an oath to uphold:
“Section 20-331(1) N.R.S. states:
1. … the Commission may authorize a civil action for appropriate temporary or preliminary relief pending filing of this disposition of the complaint under this section. Upon receipt of such an authorization, the Attorney General shall promptly commence and maintain such an action.â€

The immigration issue came to light when I was asked whether my office would represent an illegal alien against a landlord in a civil case. My position is this: While I will always prosecute a landlord who has a pattern and practice of actual discrimination, I will not file lawsuits to seek monetary damages on behalf of illegal aliens.

05-12-2008, 11:38 AM #5In regard to the recent case that has garnered so much attention, our office initially did not pursue the case because there was no evidence of discrimination, not because of the tenant’s immigration status. The tenant, who was late on his rent, was asked for a copy of his driver’s license, as was every other tenant in the complex. He was not treated any differently than anyone else. In fact, he volunteered his status and asked our office not to proceed with the case.
