    COLUMBUS, Ohio -- A man is in custody after a 9-month-old child was critically injured on Tuesday morning.

    Police said Duy Leon Cenobio was taken to Children's Hospital with severe head injuries, NBC 4's David Wayne reported.

    The child was found at an apartment complex on Alkire Glen Way shortly after midnight, police said.

    Detectives spent Tuesday morning at the apartment where the victim lived with her mother and her mother's boyfriend, 31-year-old Rutilo Morales-Gomez.

    Police said the child's mother was at work when her boyfriend suddenly showed up with the baby, who appeared injured.

    Experts said the injuries could have resulted from shaken baby syndrome, with possible brain injuries.

    Police took the mother back to the apartment for questioning, Wayne reported.

    Detectives said Gomez has no known history of violence, but he is the only suspect.

    "He was the only one here with the child at the time," said Columbus police Sgt. Dana Norman. "We conducted a search warrant to see if there's any evidence of foul play or anything wrong inside remaining, like physical evidence."

    Gomez was arrested and charged with felonious assault. He is scheduled to appear in court on Wednesday morning.

    Cenobio is listed in critical condition.

    Police said their investigation is continuing.

    So I take it he's not the baby's father? Glad he's being kept in the slammer with a high bail.

    Rutilo F. Morales-Gomez


    A 9-month-old baby who Columbus police say was shaken by a caregiver was in critical condition last night at Children’s Hospital.

    Police said the hospital called at 12:10 a.m. yesterday to report that the baby girl, Duy L. Cenobio, had been injured.

    Rutilo F. Morales-Gomez, 31, is accused of shaking the infant and has been charged with felonious assault.

    Morales-Gomez, the boyfriend of the baby’s mother, had been watching the child at their apartment at 4271 Alkire Glen Way near Alkire and Demorest roads on the West Side, police said.

    After shaking the child at 8:30 p.m. Monday, Morales-Gomez took her to her mother at work, police said. The child was taken to Doctors Hospital before being transferred to Children’s.

    Morales-Gomez is scheduled to appear in Franklin County Municipal Court this morning.

    Columbus, Ohio - The baby was not breathing, a limp bundle, when her mother’s boyfriend handed her over.

    Rutilo Morales-Gomez had stayed with the 9-month-old when her mother, Obdulia Cenobio, left for her restaurant job Monday afternoon.

    At 8 p.m., about four hours later, Morales-Gomez, who is not the baby’s father, called Cenobio to say the baby was sick. She told him to bring the baby to her job.

    He drove to the Olive Garden in Grove City (Italian resturant). Cenobio tried CPR when she realized that her daughter, Duy Leon Cenobio, wasn’t breathing and had no pulse, according to documents presented in Franklin County Municipal Court yesterday.

    Those documents, based on interviews with Cenobio, hospital officials and others, give this account of what happened:

    Morales-Gomez and Cenobio took the child to Doctors Hospital. About midnight, she was transferred to Children’s Hospital, where doctors said she had dilated pupils and significant brain damage. They called it shakenbaby syndrome and said she likely would not survive. One doctor predicted she had less than a 5 percent chance of surviving.

    She died yesterday.

    Morales-Gomez told Cenobio that after she left for work, Duy vomited, then lost consciousness. He tried to revive her, he said, by putting rubbing alcohol on her face. When that didn’t work, he held the baby upside down by her ankles. Then he shook her.

    Yesterday, Morales-Gomez appeared in Municipal Court. He was arrested Tuesday and charged with felonious assault, but a murder charge was added yesterday after the baby died.

    In court, Judge Andrea C. Peeples listened to details of the allegation against Morales-Gomez, 31, then set his bail at $2 million. A public defender stood in front of him during the hearing, blocking the view of television cameras. Morales-Gomez said nothing as a Spanish interpreter translated what was being said.
    His next court hearing is Dec. 1. Last night, he remained in jail.

    On Tuesday, police searched 4271 Alkire Glen Way, the West Side home he shared with Cenobio. Officers left with the pink sleeper Cenobio had dressed her daughter in before she left for work Monday afternoon.
