Man faces prison for failure to comply with deportation

A 28-year-old citizen of Nepal faces a maximum of 16 years in federal prison for being convicted of failing to comply with his deportation, United States Attorney José Angel Moreno announced Thursday.

On Wednesday, a jury found Om Prakash Budha guilty on four counts of failing to comply with an or-der of deportation, a press release said. Budha refused to complete an application for a Nepali passport on four different dates in an attempt to thwart his deportation, the release said.

The guilty verdict was accepted by presiding U.S. District Judge Hilda G. Tagle, the release said.

Budha was first apprehended by Border Patrol agents near Brownsville on Oct. 6, 2010, and ordered removed from the United States on Nov. 4, 2010, the release said.

He is said to have violated federal law when he refused to complete an application for a Nepali pass-port last November, December, January and February, the release said.

He will remain in custody without bond pending sentencing, which is set for Nov. 11.

Budha may be sentenced to a maximum of four years in federal prison without parole on each of the four counts of conviction as well a fine of $250,000 for refusing to comply with the deportation order, the release said.
