Man heading to prison after pulling gun in flap with ex in Carmel

CARMEL - An El Salvadoran who drove from his home in Texas last summer to Mahopac, threatened his ex-girlfriend and her new boyfriend and fired at shot at her has been sentenced to eight years in state prison, District Attorney Kevin Wright said.

Marvin Aldalborto Sorto, 24, was being held today at the Putnam County jail while awaiting transfer into the state prison system.

Judge James T. Rooney sentenced him to the eights years, plus five years of post-release supervision, earlier his week in Putnam County Court. Sorto pleaded guilty in February to third-degree criminal possession of a weapon, a felony.

Although Sorto, an illegal immigrant, faces up to five years of supervision after prison, Wright said he will likely be deported upon his release.

Carmel police arrested Sorto in July after he drove from Houston to the Buckshollow Road home of his ex-girlfriend, the mother of three children, in an attempt at reconciliation. When he saw her returning from breakfast with her new boyfriend, Sorto pulled out a pistol, pressed it against the man's stomach and ordered him into a car.

The woman ran away, but Sorto fired a shot, missing her. The boyfriend broke free and Sorto drove off to a Route 6 motel, where Carmel officers arrested him.

Assistant District Attorney Joseph Charbonneau prosecuted the case while Sorto was represented by the Putnam County Legal Aid Society.
