    . . . 10News learned from two sources within the U.S. Border Patrol that the man in custody and the man who was killed were both smugglers with the same criminal organization. The sources said the man in custody was released from a U.S. prison in January and was convicted in 2008 on smuggling and assault charges.

    The man who was killed also had a record, according to the sources. They said he had 19 prior known cases of smuggling and assaults. . .

    The FBI is investigating a deadly shooting at the U.S.-Mexico border between U.S. Customs and Border Protection agents and a man trying to enter into the U.S. illegally.

    The suspect, who was shot and killed Tuesday night near San Ysidro Port of Entry, was throwing rocks at the agents when he was shot and killed officials said.

    Two agents called for help from San Diego police, saying they were being attacked with rocks and sticks near the border fence line around 7:30 p.m. Tuesday.

    Investigators said the incident involved three people crossing the border fence east of Dairy Mart Road.

    A second agent was called in for backup when an agent spotted the group crossing through a hole in the fence.

    Two suspects fled back into Mexico through the opening but agents caught a third suspect who resisted arrest officials said.

    During the scuffle, another suspect started throwing rocks and a piece wood with nails at the agents from the other side of the fence, striking one of the agents.

    As the suspect began to throw another large rock at the agents, the first Border Patrol Agent fired his service weapon at a suspect, striking him once, police said.

    That conflicts with reports from police in Tijuana, Mexico, who say the man was shot in the torso and head according to the Associated Press.

    The unidentified suspect then fell back across the fence, landing on the Mexico side of the border, police said.

    The local ACLU, citing accounts from Mexico, said Jose Alfredo Yañez Reyes was with his wife and baby on the Mexican side of the border before the shooting.

    Mexican authorities identified the victim as Jose Alfredo Yanez, 40, of Tijuana.

    Heriberto Garcia, the Baja California state human rights ombudsman, said Yanez worked at a towing company and had a young child with his 18-year-old girlfriend, who is five months' pregnant with their second child.

    Mexico's Foreign Relations Department says in a Wednesday statement that it has asked for a thorough investigation of the death.

    It says it was "disproportionate" for the officer to use firearms to repel an attack with stones.

    Shawn Moran, Vice President of the National Border Patrol Council Local 1613, considered the reaction of agents in line with the rules of engagement for agents protecting the U.S. border.

    So, are you suggesting that the Border Patrol agents throw rocks and spit wads back at people who obviously are trying to injure or kill them???! Jackass. Let's chain your sorry arse to a fence post at the border with a sign that says "Border Patrol Agent" and see how long you'll last.

    Just once I'd like to see an article from the LA Times that backs up our Border Patrol agents who risk their life everyday along our so-called secured border. What would they do if someone was throwing rocks and boards with nails at them? If one of those rocks or boards had seriously injured an agent the story would be totally different wouldn't it?

    Human rights groups urge Congress to investigate Border Patrol's use of deadly force

    Lawmakers are asked to look into a policy that allows agents to shoot at rock throwers along the U.S.-Mexico border. The ACLU and others argue that the practice is inhumane.

    A coalition of immigrant and human rights groups Friday urged Congress to investigate the Border Patrol's use of deadly force against rock throwers along the U.S.-Mexico border, saying the frequency of such confrontations is disturbing and inhumane.

    The request came three days after an agent in San Diego fatally shot a 40-year-old Tijuana man suspected of injuring an agent by throwing rocks and a nail-studded wooden board.

    Such incidents typically lead to demands for congressional scrutiny, but Congress in recent years has not taken up the issue. The letter, addressed to congressional committees, was signed by 65 national and regional groups, including the ACLU of San Diego & Imperial Counties and Amnesty International.

    Although confrontations between agents and smugglers have declined substantially in recent years, rock throwing is not uncommon in many urban areas where trafficking groups use aggressive tactics to prevent agents from arresting illegal immigrants.

    Last year, agents in El Paso killed a teenage boy who was reportedly throwing rocks at them. Other alleged rock throwers were killed in the Arizona towns of Nogales and Douglas within the last year, according to the ACLU.

    Agents involved in fatal shooting incidents are usually cleared of wrongdoing by local and federal authorities. The agency has said deadly force is justifiable because rocks and other objects can cause disabling and sometimes fatal injuries. Numerous agents have been hospitalized over the years because of head wounds, authorities said.

    Critics argue that countering rocks with bullets amounts to an unacceptable and disproportionate use of force and should be stopped.

    "Deadly force should always be an action of last resort and only used if an imminent risk of death is present … to shoot stone throwers is exceptionally disproportionate and inhumane," the letter states.

    Authorities declined to comment on the investigation into this week's shooting. A leading Tijuana newspaper, Frontera, provided some details about the victim, reporting that he had been caught trying to cross the border 17 times since the 1990s. Citing official sources, the newspaper reported that the man worked as a mechanic and was also suspected of being a human smuggler.
