    Mass. - Police: Family's vehicle crashed into by drunk driver in country illegally

    ​AUBURN, Mass. —
    Police said a family of four was hurt when a drunk driver who authorities say admitted to being in the country illegally crashed into their vehicle Thursday afternoon.

    Auburn Police said the man, identified as Jose Acevado, 43, struck the family's vehicle from behind in the area of Route 20 and Mill Street.

    Authorities said there were injuries to both adults, including a possible broken neck to the mother of the two children in the vehicle.

    Police said Acevado registered a .26 blood alcohol content level when tested at the police station, over three times the legal limit.

    According to police, Acevedo admitted to entering the United States illegally through Mexico from El Salvador and to not having a driver's license.

    Acevedo will be arraigned in Worcester District Court Friday on charges of OUI Alcohol, operating a motor vehicle negligently and unlicensed operation of a motor vehicle.

    Police did not release the names or updated conditions of the victims in the crash.

    Oh that is so sad. Broken neck, that is awful. I hope there is no permanent damage, no paralysis, and that she can fully recover.

    Charges upgraded for man arrested in Auburn crash

    AUBURN - Charges have been upgraded against a man who told police he was an illegal immigrant after being arrested Thursday following an accident in the area of Route 20 and Mill Street.

    Jose Acevedo, 43, of 188 Chandler St., Worcester, was initially charged with driving under the influence of alcohol. That charge was upgraded to driving under the influence of alcohol causing serious bodily injury. Mr. Acevedo’s Chevrolet crashed into the back of a 2015 Subaru Outback. Two adults and two children were in the Outback. A woman in the vehicle suffered a possible broken neck, police said.

    Mr. Acevedo was also charged with driving negligently and driving without a license. Earlier Thursday, about 5 a.m., he was also arrested by Worcester Police on a warrant for operating a motor vehicle without a license.

    Auburn Police Chief Andrew J. Sluckis Jr. said Mr. Acevedo was brought to court, paid the fines he owed from a previous case, and was released. At some time following his release, he drove to Auburn and was involved in the accident.

    The U.S. Immigration and Customs Enforcement Service is reviewing Mr. Acevedo’s case. Chief Sluckis said Auburn Police contacted ICE after Mr. Acevedo was not able to present them with a valid drivers license.

    “All he had was a passport and that triggered questions about his immigration status,” he said. “He said he has been in the country for quite some time. He came here illegally through Mexico.”

    An ICE spokesman said deportation officers attempted to interview Mr. Acededo on Friday, but were unable to do so.

    “ICE officers were unable to gain access to the individual because a court supervisor would not allow ICE officers to speak to Mr. Acevedo until the local court appointed an attorney to him in his state criminal proceedings,” Shawn Neudauer said in an email. “While Mr. Acevedo has allegedly admitted to local law enforcement that he is in the U.S. unlawfully, ICE cannot verify the accuracy of his alleged statements until our officers interview him and compare his biographical data against federal immigration records.”

    The incident comes at a time when the state is considering the Safe Communities Act, which would draw a line between local and state law enforcement agencies, and federal immigration enforcement. The law would separate federal law enforcement from local and state police arrests, prohibiting access to booking information or the transportation of a person under arrest locally to a federal facility.

    The Legislature’s Joint Committee on Public Safety held a hearing Friday on Senate and House of Representatives versions of the bill.

    Chief Sluckis said he is opposed to the idea of a statewide safe communities mandate.

    “I think it should be up to each individual city and town to determine what is best for them,” he said, adding that he would like to continue having local and state law enforcement working with federal law enforcement for the betterment of all.

    This is not a safe community because you didn't call ICE the first time you arrested this freak illegal alien. Now you have him back on the roads driving drunk and unlawfully, crashing into a family and breaking the mother's neck.

    What is wrong with you people? Are you insane? Is there so much illegal drug money floating around in Auburn that you just can't say "CALL ICE AND GET THIS FREAK OUT OF OUR TOWN AND OUT OF OUR COUNTRY BEFORE HE KILLS SOMEONE?"

    Are you all that bribed, that bought, that you would knowingly and willfully release illegal aliens back onto the streets instead of doing your jobs and calling ICE?!! Public officials involved in this dangerous and deadly scam against US citizens need to locked up, because you're all crazy and evil.
