DA: Two indicted in beating death of immigrant

The Brooklyn district attorney's office says two men have been indicted in the beating death of an Ecuadorean immigrant.

District Attorney Charles J. Hynes plans to announce the indictment charges and other details at a Tuesday news conference.

Keith Phoenix and Hakim Scott were arrested last week on charges of second-degree murder as a hate crime. Phoenix has said it was self defense.

The men are accused of shouting Hispanic and gay slurs as Jose Sucuzhanay and his brother walked arm-in-arm to keep warm on Dec. 7.


Police say Phoenix savagely beat Sucuzhanay with an aluminum baseball bat.
