    Illegal immigrant pleads guilty in crash that killed motorcyclist in Holland Township

    HOLLAND TOWNSHIP — A man who struck and killed a motorcyclist in Holland Township in July pleaded guilty to negligent homicide Monday in Ottawa County Circuit Court.

    Rodrigo Delacruz-Encarnacion, 25, could face a maximum two-year sentence for the charge. He will be sentenced Jan. 26.

    William O'Brien, 52, died at the scene after being struck by a van driven by Delacruz-Encarnacion on July 23.

    Police said Delacruz-Encarnacion is an illegal immigrant from Mexico who had been residing in Michigan for about two weeks prior to the crash. Court documents showed his wife and two children were still residing in Mexico just after the crash.

    Delacruz-Encarnacion was originally charged with two felonies — failure to stop at the scene of a fatal crash when at fault and driving without a license causing death. He could have served 15 years in prison for those charges, but pleaded guilty to the lesser charge of negligent homicide.

    After sentencing, Delacruz-Encarnacion will serve the prison time the judge dictates. His case will then be examined by the federal Immigration and Naturalization Service to determine if he will be deported, Ottawa County Assistant Prosecutor Craig Bunce said.

    Delacruz-Encarnacion's attorney, David Macias, did not return a call for comment.

    This just never changes, does it? If I had a dollar for every time I've read about them running from the tragedies they cause, I could take a vacation.

    Disgusting! Another innocent American who would still be with us if our immigration laws were enforced. And I suspect he will be out in 8 mos

    Yes, and then "deported" to the border where he can wait 20 feet on the other side to walk right back into the U.S.
