    OREGON CITY -- The family of a Texas girl murdered in 2007 is suing Clackamas County, claiming law enforcement officers knew her killer illegally entered the United States and failed to report him to immigration authorities.

    The estate of Dani Countryman is seeking $3.5 million in damages, according to the Clackamas County Circuit Court filing.


    Countryman, 15, died during a sexual assault July 28, 2007, after an all-night party at an Oak Grove apartment complex. She was in Oregon visiting relatives.

    Edward S. McGlone III, assistant Clackamas County counsel, declined to comment on the complaint.

    Alejandro Emeterio "Alex" Rivera Gamboa, 26, was sentenced to life in prison, with the possibility of parole after 35 years. He attempted to subdue Countryman, fatally choking her, as his cousin, Gilberto Javier "Gabe" Arellano Gamboa, tried to rape her.

    Arellano Gamboa, 25, was sentenced to five years, 10 months in prison.

    Both men were in the country illegally and will be deported to Mexico after serving their sentences.

    The lawsuit claims that a Clackamas County probation officer and unnamed sheriff's office employees failed to report Rivera Gamboa to the Immigration and Customs Enforcement.

    The Oregonian reported that Rivera Gamboa pleaded guilty to drunken driving in November 2006. He signed a plea agreement that stated he was not a U.S. citizen and was released without anyone in the criminal justice system notifying immigration authorities.

    This young girl was visiting her sister, and the older sister had to go somewhere and thought her sister in a safe place. If I remember correctly.

    The police and city should have to pay dearly. And the police should do time for indirect murder.

    Every victim of an IA crime should sue the local and state gov't if the IA had any previous encounters with the law.

    There should be an American Million Dollar Fund like the money the 9-11 victims. Americans on the local streets are endangered, too. The governments, courts, police, and other agencies are all guilty.

    Family of murdered teen sues county

    CLACKAMAS COUNTY, Ore. -- The family of 15-year-old murder victim Dani Countryman is suing Clackamas County.

    According to public records, the suit alleges authorities knew Countryman's killer was in the country illegally but failed to report him. Indeed, in November 2006 the person who plead guilty to Countryman's murder was convicted in Clackamas County of driving drunk.

    The suit asks for $3.5 million for damages caused by the death of the 15-year-old from Texas. She was killed during a sexual assault at a party in Milwaukie, Ore., in 2007. Countryman was in Oregon to visit her sister in Oregon City.

    Two years later, Alejandro Rivera Gamboa has been sentenced to life in prison after pleading guilty to the murder in a plea deal July 2009. The judge sentenced him to life in prison, of which Gamboa will have to serve at least 35 years.

    His cousin, Gilberto Arellano Gamboa, reportedly will serve nearly six years in jail for attempted sexual abuse.

    Both men have admitted crossing into the U.S. illegally from Mexico. Both men will be deported after they serve their sentences.

    A third party in the death, Shon Jerrod Estes, had charges of sexual abuse and attempted rape dropped in exchange for a plea in Clackamas County Circuit Court. Estes was sentenced to 45 days in jail, followed by 24 months of probation.

    This case reportedly prompted Clackamas County to define its policy on the handling of immigrant criminal cases. Two months after Countryman's death, Clackamas County authorities clarified county law giving police and prosecutors the ability to report non-documented individuals to immigration officials after they have been arrested on other charges.

    This is exactly why we need strict internal enforcement of our immigration laws. Not to do so is just waiting for a crime to happen. These people need to be deported BEFORE they commit a crime, not AFTER.
