WHITE PLAINS, N.Y. – An illegal immigrant living in White Plains struck an employee of Anthony’s Deli on the head with an umbrella Tuesday night after he claimed the worker insulted him in Spanish, police said.

The deli worker, a 28-year-old Sleepy Hollow resident, told police the man came into the store with a friend and left without buying anything, then later came back and accused the employee of calling him a “baboso,” or “idiot,” police reports said.

Officers spotted the man with four friends on E. Post Road, where he said his name was Rudy Gonzalez, according to police. He was brought to headquarters and fingerprinted, which caught the attention of the U.S. Department of Homeland Security.

Police said that according to Homeland Security officials, the name and birthday he gave to police were both inaccurate. Officers learned the man’s name is Rudolfo Viveros, 39, and received his immigration detainer information, which also confirmed his identity with state officials.

Viveros was arrested and charged with one count of third-degree assault, a misdemeanor, and one count of second-degree forgery, a felony.

The deli worker refused medical care for a small cut on the back of his head.
