Motion Filed to Prevent Defendant in Immigration Fraud Case from Fleeing Guam

Choon Kang and her brother Byong Kang are accused of lying to federal authorities in order to get $20 million federal contract.


Guam - The US Attorney’s Office is asking the federal court no to allow a woman accused of visa and immigration fraud to travel off-island.

In court papers filed in District Court, Assistant US Attorney Stephen Leon Guerrero says that if allowed to travel, Guam Construction Company Vice President Choon Hee Kang may never return to Guam to face prosecution.

Choon Kang and her brother, GCC President Byong Kang, are facing charges of visa and immigration fraud as well as illegal harboring of aliens.

Leon Guerrero says Choon Kang has not provided enough proof that her medical condition is severe enough that she must be treated in South Korea. He says there’s no evidence to suggest that there aren’t any specialists on Guam or anywhere else in the US who could treat her.

Other flights risks Leon Guerrero points out is the fact that Choon is a citizen of South Korea, she does not have significant family ties on Guam and that she has financial resources in her home country after federal agents determined that she had moved hundreds of thousands of dollars between Guam and South Korea in the past.
