    MS-13 gang member sentenced to 12 months for illegally re-entering United States

    El Salvador native previously sentenced to 25 years for raping 8-year-old girl


    ALEXANDRIA, Va. — A citizen and national of El Salvador and a member of the MS-13 street gang who was previously convicted of sexually assaulting a child in Fairfax County, Va., was sentenced to 12 months in federal prison today for illegally reentering the United States after having been previously deported.

    The case of illegal re-entry was investigated by U.S. Immigration and Customs Enforcement's (ICE) Enforcement and Removal Operations (ERO).

    According to court documents, Salvador Portillo, 30, illegally entered the United States and was removed by ICE Oct. 8, 2003. Thereafter, Portillo again illegally reentered the United States.

    On Dec. 26, 2010, he sexually assaulted an 8-year-old girl in Fairfax County, Va. He was subsequently convicted of rape and sodomy in Fairfax County Circuit Court and sentenced to 25 years in prison. The 12 month sentence for illegal re-entry will follow the completion of the sentence term imposed by Fairfax County.

    Portillo pleaded guilty to illegal re-entry July 23.

    Too little! Too late! Our existing border and immigration laws should have been enforced long before another child was sodomized by an invader on American soil.

    They were supposed to secure the border after the Reagan amnesty in 1986 but they never got around to it. And no president or congress since then has taken care of the problem.

    On the day after Christmas, an 8-year-old Fairfax County girl told her mother that a
    family friend had raped her earlier in the day. On Wednesday, Fairfax police conducted a manhunt for the "friend," an alleged member of the Mara Salvatrucha street gang, with warrants for forcible rape and forcible sodomy.
    The attack occurred in the girl's bedroom about 10:30 a.m., in a townhouse on Cardigan Square in Centreville, Fairfax Detective Darrin DeCoster said. Other people were in the house but did not hear anything, DeCoster said. The girl reported the incident later in the day, and "we do have evidence to support that allegation," DeCoster said.

    Police obtained warrants for Salvador Portillo-Saravia, 29, of Sterling, but have not been able to locate him.
    On Wednesday morning, Fairfax detectives and U.S. marshals were canvassing the area around Sterling Boulevard and Route 7, looking for clues to Portillo's whereabouts.
    "We believe he's still in the Northern Virginia area," DeCoster said, though police do not believe Portillo, a native of El Salvador, was in the country legally. He is an acquaintance of the victim's mother, police said.
    Portillo is described as 5-foot-9, weighing 185 pounds, with "MS13" tattoos on his chest and other gang-style tattoos on his hands, arms and upper body. He was not armed at the time of the attack, but "anyone that's willing to take advantage of and assault an eight-year-old in the way this suspect did is obvously a danger to society," DeCoster said.

    Fairfax fugitive nabbed in Houston

    A man wanted for rape in Fairfax County, who had been released from custody in Loudoun County a month before the assault because of an apparent gap in immigration databases, was captured Sunday in Houston, Fairfax police said Monday.

    Salvador Portillo-Saravia is being held in the Houston jail pending extradition to Fairfax. His case highlighted flaws in the much-touted Secure Communities program that is supposed to keep dangerous illegal immigrants off the street.

    Authorities said Portillo-Saravia, 29, was a member of the street gang MS-13 who had been picked up by gang officers in Prince William County in 2003 and deported.

    Portillo-Saravia sneaked back into the country and was arrested again in Loudoun County in November. Loudoun sheriff's deputies submitted his fingerprints through the Secure Communities program. The ICE database should have flagged him as someone who had been deported and he should have remained jailed.
    But Portillo-Saravia's prints came back with a "no match." Charged only with the misdemeanor of being drunk in public, Portillo-Saravia was released after 12 hours in the Loudoun jail.

    About a month later, on the day after Christmas, he allegedly raped an eight-year-old girl in her home in Centreville. A massive manhunt began.

    When it was revealed that Portillo-Saravia had been in the Loudoun jail a month earlier, ICE disclosed last week that the fingerprints of many deportees obtained before 2005 were not taken electronically and not in the database. Participants in the Secure Communities program, which includes every jail in Virginia, said they were unaware that the database was not comprehensive.

    ICE officials said they were reviewing their files to see how manually inked fingerprints can be scanned into the IDENT database used by the Secure Communities program. Rep. Frank Wolf sent a letter to ICE asking for a report on how the problem can be fixed.

    Fairfax Officer Don Gotthardt said agents with ICE in Washington and Houston, federal marshals and Fairfax detectives were all involved in tracking and capturing Portillo-Saravia. Portillo-Saravia is charged with forcible rape and forcible sodomy in the Dec. 26 attack on the girl.

    Most of the MS-13 members have been arrested so many time they wouldn't be eligible anyway.

    It depends on which ID they use and how careful the agency that screens them is before they are granted - amnesty. I don't have a lot of faith that these people will be screened thoroughly based on the past performance of DHS.

    To me this seems so simple to understand, but no one says it. Reagan promised a secure border knowing that contributors from big business woud now get more low wage volunteers (now called "undicumented'). Big business contributors likely objected to secure borders. Democrats quickly recognized these volunteer workers would need benefits as they are not often porvided to low wage workers. Bingo, Dems get bleeding heart voters and repubs got satisfied contributors. Win-win for both parties, but headaches and heartaches for real citizen taxpaying American workers.

    This is why I will not vote for either party and want another party taking root and loudly renouncing illegal immigration.
