MT: Illegal alien gets 14 years in large cocaine conspiracy

Illegal alien gets 14 years in large cocaine conspiracy

    By CLAIR JOHNSON
    Of The Gazette Staff

Chief U.S. District Judge Richard Cebull Tuesday sentenced an illegal alien from Mexico to 14 years and two months in prison for trafficking large amounts of cocaine in Billings and elsewhere.

Cebull sentenced Juan Flores, 31, of Denver, at the middle of the guideline range. Until the sentencing, Flores had been identified as Abraham Goytia, which was not his true name.

Flores pleaded guilty in September to conspiracy to distribute cocaine in a trafficking scheme that ran from 2004 until 2005. Flores and co-defendants were accused of bringing large quantities of cocaine from Denver to Billings and to Washington, D.C.

Cebull held Flores responsible for at least 37 kilos, or about 81 pounds, of cocaine. About two kilos of cocaine came to Billings, while Flores and others trafficked about 37 kilos in Washington D.C.

The judge did not hold Flores responsible for another 30 kilos of cocaine that was seized in Denver or 10 kilos of cocaine that were to be sent to Alaska saying the prosecution failed to present convincing evidence that Flores was involved in those amounts.

Flores apologized and through a Spanish-speaking interpreter said he had made bad decisions. Cebull ordered Flores to be deported after he completes his sentence.

Flores, along with David Stubbs of Billings, Jesus Lugo-Brown, of Aurora, Colo., and Jeanette Rocha, of Evans, Colo., and Fausto Bonilla-Dominquez, of Longmont, Colo., were charged with conspiring to traffic more than 4 pounds of cocaine in the Billings area. Prosecutors alleged Stubbs and co-defendants negotiated for the delivery of 2 kilos of cocaine to an undercover agent with the federal Drug Enforcement Administration. The price was $23,000 per kilo, which is 2.2 pounds.

Stubbs was convicted and sentenced to 37 months in prison, while Lugo-Brown was sentenced to 30 months in prison. Bonilla-Dominquez was sentenced to five years in prison. Rocha is a fugitive and is believed to have fled to Mexico.
