    Murder charge announced in Border Patrol agent's vehicular death

    SAN DIEGO – Federal prosecutors on Thursday announced a murder charge against a man accused of hitting and killing a Border Patrol agent last year.

    The three-count superseding indictment, obtained by U.S. Attorney Karen P. Hewitt, charges Jesus Navarro-Montes, 23, of Mexico with possession of marijuana, conspiracy and second-degree murder.

    Authorities said Navarro-Montes struck and killed Border Patrol Agent Luis Aguilar with a Hummer H2 on Jan. 19, 2008.

    Aguilar, 32, was on duty in the Imperial Sand Dunes Recreation Area in Imperial County when he was run over by the SUV, according to the indictment. The agent was setting spike strips on a road to try to stop suspected drug smugglers.

    Officials believe Navarro-Montes conspired to distribute hundreds of pounds of marijuana before the deadly crash.

    Navarro-Montes was first arrested Jan. 22, 2008, in the state of Sonora. He was held in a Mexicali prison until June 2008 when Mexican authorities said he was released because U.S. officials did not request his extradition.

    He was rearrested Feb. 11 near Zihuatanejo, Mexico.
    A federal grand jury issued the new indictment May 6 and it was unsealed Thursday.

    Navarro-Montes had been indicted in February by another San Diego federal grand jury on drug charges. That indictment accused him of possessing with intent to distribute about 980 pounds of marijuana in September 2007.
    Navarro-Montes was arrested by Mexican authorities and remains in jail in Mexico. U.S. officials have requested that he be extradited.

    It appears the laxity of law enforcement and justice in this country knows no bounds when a murderer isn't extradited back to stand trial on his first arrest.

    This political game of "no border" and "respect every human right" demeans the life of the Border Patrol Agent and speaks volumes about the way this country shrugs it's shoulders at criminals who take advantage of said laxity and an open border policy.

    An accused murderer has no right to hide. Said murderer does have a right to a fair trial and to face his accusers. That right is every "human's right" and that doesn't recognize any border but is known as justice.

    This is about the second or third posting I have read here where a Hummer was involved in some sort of illegal activity. Perhaps these Hummers should be considered as peripheral weapons of destruction.

    It wasn't Mexico's fault.

    The U.S. didn't process the extradition papers so the Mexican judge couldn't extradite him.
