    Myrick announces new bill. ALIPAC says use existing laws!

    GASTONIA, N.C. - Reacting to the death of an N.C. man in a drunken-driving wreck involving an illegal immigrant, U.S. Rep. Sue Myrick on Monday unveiled a proposal that she said would make local police more responsible for tracking illegal immigrants, Myrick said.

    Myrick named the "Scott Gardner Act" after the Mount Holly resident killed in an apparent drunken-driving wreck July 16 in Brunswick County. Ramiro Gallegos of Mexico, convicted of driving while intoxicated three times but never deported, faces second-degree murder charges in the wreck.

    Gardner's family attended Monday's news conference but did not speak. Gardner's wife, Tina, was critically injured and remains hospitalized. Their children, 5-year-old Jackson and 2-year-old Avery, suffered minor injuries.

    The legislation would require all state and local law-enforcement agencies to report immigration status, deportation orders and failures to appear to the FBI's National Crime Information Center database within 30 days of the incident.

    Officials also would have to enter all driving while impaired convictions into the database. DWI, a misdemeanor, would become a deportable offense and judges would have access to national data for better sentencing, Myrick said.

    "No more excuses," Myrick said. "No more endless appeals. You're drunk. You're driving. You're illegal. You're deported. Period."

    The act is one of several initiatives Myrick announced, including creating an Immigration and Customs Enforcement agency in the Charlotte region, adding more deportation officers and increasing fines for businesses that knowingly hire illegal immigrants.

    North Carolina should not have to rely upon the regional Atlanta office for decisions, Myrick said.

    "[Atlanta is] slow to respond and quick to seize the manpower slated for our area for themselves."

    North Carolina has one deportation officer and an estimated 300,000 illegal immigrants.

    William Gheen, president of Raleigh-based Americans for Legal Immigration, said lawmakers should focus on spending the money and enforcing existing laws, including 1996 legislation giving local police authority to arrest illegal immigrants.

    This year, the U.S. House approved $635 million for more than 700 border patrol agents, immigration investigators and detention officers and 1,950 detention beds. The House also approved $61 million for border security technology and $40 million to train state and local police to enforce immigration laws.

    Angeles Ortega, director of the Latin American Coalition in Charlotte, said the possible laws shift focus away from the main problem in Gardner's death: drunken driving.

    "Instead of making DWI a felony instead of a misdemeanor, they are going after illegal immigrants," Ortega said.

    well, heck lets do both make DWI involving an accident a felony and deport for any DWI (I would go for deport for any traffic offense, speeding, stop sign, spitting on the sidewalk).

    It doesnt make sense to me. You vote for CAFTA which opens our borders like NAFTA did and then you vote against illegal immigration. Do you smell someone trying to drum up votes? I hope I get to ask her a question tonight.

    Have we forgotten? NAFTA came first, under which a foreign tribunal was able to override U.S. laws and give Mexican trucks access to all U.S. highways. Now we have the Congress-approved Central American Free Trade Agreement that integrates our prosperous economy with the poverty of six Central American countries. Add more alphabet soup and we have the pending FTAA -- Free Trade Area of the Americas.

    They all intend to follow the same path pushing for full integration of the 34 countries of the Western Hemisphere. It's important to remember that the socialistic European Union was initially sold to the European public as a "free trade" area as well.

    Breaking our Laws

    This is personal for me. I live in Mount Holly, NC; the small town that the family involved in the car crash was from. They have 2 small children; one is named Jackson. I have a son named Jackson. One of them is two years old. My son is two years old. So, this hits home for me. I ache for this family. Because I know that it could have been us. And if he hadn't been here this incident would not have occurred.

    NC has tough drunk driving laws. They take it very serious and I appreciate that. The problem is not with our drunk driving laws. They are strict and substantial. The problem is that that driver was breaking the law before he even started drinking. And long before he even got behind the wheel drunk. He should not have been here. Every moment he was in this country he was "illegal" and therefore, breaking our law. Those who break the laws of the land are considered criminals.

    Per Meriam Webster's Dictionary, "Illegal" means "not according to or authorized by law." All people, regardless of race or country of origin, should be deported immediately upon entering this country if they come here without legal authorization. And, if they do get in illegally and commit a crime of any kind (misdemeanor or felony), they should be be punished according to the law for their crime; then deported and never be allowed to return.

    Welcome to ALIPAC!. I too share your concerns. But the reason that so many illegals are here are many:

    Open Borders Created by NAFTA and the New CAFTA Bill
    Immigration Laws Not enforced
    Local Police hands are tied.

    I don’t see new laws helping much if they are not being enforced. We have laws in place and our elected officials are not doing anything to ensure they are enforced. I feel for this family and it should have never happened and would not have if our borders were sealed.

    Welcome, you are very correct! I was born and raised just down the road about 40 miles from Mt. Holly so the story hit home for me as well.

    All across Western North Carolina, huge numbers of people are forcibly having their eyes opened to how bad our illegal immigration problem and immigration enforcement problem is. The first person they can see in a position of responsibility on this issue is Congresswoman Sue Myrick.

    ALIPAC officially endorsed Sue Myrick in 2004 for her improving record on immigration enforcement. Our decision for 2006 will be made when the elections start and in some cases before then.

    Later this month, we will issue an official statement to every member of Congress. Any member of Congress that votes for the Bush Guest Worker / amnesty / reward for illegal aliens plan will not be supported by ALIPAC and we will actively pursue their defeat in 2006 instead.

    Congresswoman Myrick indicated to ALIPAC, in 2004, that she would oppose any amnesty or guest worker proposals. This means she will have to illustrate the strength to be at odds with President George Bush. We are confident she will honor her pledge and remain loyal to the public.

    We applaud her efforts to offer new legislation, but ALIPAC's main focus is simply enforcing our existing immigration laws. Our real problem is lack of enforcement more than a need for more legislation.

    Myrick's political survival depends on how she handles this issue. She has big money interests whispering what she should do in one ear and angry citizens lining up at the gates with pitchforks and torches yelling in the other.

    She has three fundamental choices. 1. Go with the big money and lose her seat. 2. Go with the public and face fierce opposition from the pro-illegal financial influences and a loss of PAC money. or 3. Try to placate the public while secretly following the agenda of those that are responsible for the non-enforcement of our immigration laws and thus the death of Scott Gardner.

    Far to many politicians are chosing path 3 these days. We will continue to watch closely and do all we can to assure that the public receives accurate information on this issue.
