RAEFORD, N.C. -

A driver who crashed into a Hoke County family, killing the father, mother and son, is suspected of being in the United States illegally, WNCN confirmed Monday.

The wreck occurred just before 10 p.m. Friday at the intersection of N. Old Wire Road and N. Shannon Road outside Raeford when a truck driven by Rodolfo Marin Vela, 29, of St. Pauls, ran a stop sign and slammed into an SUV driven by Jamie Oxendine, 43, of Red Springs.

Both vehicles ran off the road and came to rest on private property after the collision.

Jamie Oxendine, his wife Mary Ann Oxendine, 40, and Austin Shane Oxendine, 17, were all killed in the wreck.

The U.S. Immigrations and Customs Enforcement said Vela is in the country illegally. He remained in jail Monday on a $750,000 bond.

Documents in the case said Vela "had odor of alcohol about breath. Red bloodshot glassy eyes. Visible injuries." Results of a blood test are not expected for four to six weeks.

"Such a tragic thing. It's something that could have really been avoided," said Rev. John David Hunt, who knew the Oxendine family. "An accident is one thing, but a deliberate cause that brings about this kind of hurt is just hard to get a grip on."

The documents do not list Vela as having a Social Security number of drivers license number. His next court date is March 5.

Vela and his passenger, Martinez Misael-Tomas, 25, were injured and taken to Cape Fear Valley Medical center.

Vela is facing charges of driving while impaired, reckless driving, three counts of felony death by vehicle, stop sign violation, driving with no license, seatbelt violation, open container of alcohol, and exceeding safe speed for conditions. He's being held in the Hoke Count Detention Center. Vela is scheduled to appear in court March 5.

Vela was previously arrested in Raleigh in September 2014 for being intoxicated and disruptive.

The Oxedines leave behind three other children, aged 16, 18 and 23. Services for the family are still being finalized.

Vela was previously arrested in Raleigh in September 2014 for being intoxicated and disruptive.

It's a real shame Raleigh Police didn't hold him for immigration violations so he would have been in jail or deported before he killed this family. If the US Congress had passed Marsha Blackburn's bill that acknowledges the states rights to enforce US immigration law and authorizes them to do so, then States like North Carolina and cities like Raleigh could deport these people before they inflict further harm on Americans or in this tragic case, kill an entire family.
