FRANKLIN TWP. - An illegal immigrant who authorities said was driving drunk and without a license was involved in a motor vehicle accident here that fatally injured a Deptford Township woman, police said Friday.

The crash occurred about 5:35 p.m. Thursday at the intersection of Main Road and U.S. Route 40.

Mijail L. Hernandes, 24, of Lake Worth, Fla., was driving a 2000 Chevrolet Suburban west on U.S. Route 40 and failed to stop at a red light, police said.

The Suburban hit a 2008 Hyundai Tucson driven by Yvonne M. Pennewell, 51, which was traveling south on Main Road, also known as Gloucester County Route 555, said police.

The Hyundai was forced off the road.

Pennewell and her passenger, Crystal D. Ashmore, 25, of Vineland, were trapped in the vehicle and had to be freed by rescue crews. Both women were airlifted to Cooper Medical Center in Camden.

Pennewell died at Cooper. Ashmore was listed in serious condition on Friday, said police.

Hernandes was taken to South Jersey Regional Health Center in Vineland, treated for minor injuries and released into police custody.

He was charged with death by auto, aggravated assault with a motor vehicle, being an unlicensed driver resulting in death, unlicensed driver resulting in serious bodily injury, driving while intoxicated, failure to obey a traffic device, reckless driving and failure to wear a seat belt.

The car carried a Florida registration, but police are uncertain whether the documents are real.

Hernandes has been committed to the Gloucester County Jail in Woodbury in default of $250,000 full cash bail.

Police officers at the scene recalled a similar case almost five years ago.

"We're doing everything in our power on the law enforcement side to make sure we don't have another situation like Juan Bautista," said Detective Sgt. Rick O'Brien.

On Sept. 16, 2003, Juan Bautista, a Mexican national, crashed a 1994 Ford Explorer into a car driven by Christina Applegate, who was heading to Bridgeport to take lunch to her husband at work.

Applegate has been in a coma since the crash.

Bautista's blood alcohol content was above the legal limit.

He was in the country illegally, but was able to walk away Ã

Hernandes will now have to appear in immigration court where, if he is not found guilty on criminal charges, he could be deported.
He could be deported? There shouldn't even be a question that he be deported. He's already committed other crimes, and that tells me he won't stop at this one if let go. What in the hell is wrong with people.
