    A repeal for a driver's license law gains momentum

    ANTHONY, New Mexico —

    New Mexico Gov. Susana Martinez and Rep. Andy Nunez driver's license repeal law is gaining momentum in state legislature.
    On Wednesday, house representatives approved the bill enabling undocumented immigrants to obtain driver's licenses 45-25.

    The bill now heads to the Senate where if it carries enough momentum it will pass.

    Some residents tell KFOX14 that it's not smart because it will make it difficult for state police to track them.

    "They'll still be doing it. Its better for them to have some sort of documentation rather than nothing," said Victoria Espinoza who was visiting New Mexico from California.

    Espinoza also thinks it's up to the federal government to create immigration laws.

    Other agree with the bill, saying illegal immigrants have no rights.

    "Your coming to the United States and you've got to obey the laws," said Enrique Serano a legal immigrant from Mexico.

    Senate Owes Public A Driver's License Vote

    Last year Albuquerque Democratic Sen. Eric Griego said the debate over handing out driver's licenses to illegal immigrants had "sucked the oxygen out of this building. For what? This isn't the people's work. This is divisive. This is a waste of time."

    This year, with less than a week left in the 2012 legislative session, he's at least partially right. It's time for the Senate to stop wasting oxygen and time and hold an up-or-down, roll-call vote.

    For the second year in a row, members of the New Mexico House have had the courage of their convictions - whether they support repeal or not - addressing the 2003 law that has the state handing out state-ofthe-art government identification to illegal immigrants in violation of federal law. For the second year in a row, members of the New Mexico House have voted to end the practice, this time by a wider margin of 45-25.

    And for the second year in a row, members and leaders of the New Mexico Senate are busy wasting oxygen and time on empty compromises that provide differences without distinction from current practice. Fingerprinting applicants and requiring yearly renewals won't put the state into compliance with federal immigration law and the pending Real ID Act. Especially when those applicants are new to the United States and a random sampling shows a third of current illegal immigrant licensees don't live at the address they provided to the Motor Vehicle Division. The suggested provisions won't stop someone who fraudulently obtains a New Mexico license from trading it in for a license issued by another state.

    If senators really believe the current practice makes the state's roads safer without compromising security, and that outweighs federal law, then they should be willing to vote their beliefs and then either bask in voter approval or face the backlash.

    Voters should not be deprived of their opportunity to weigh in because senators duck casting a controversial vote on repeal for a second year in a row.

    State senators should join their House counterparts and show the public that elected them they, too, have the courage of their convictions by at least voting up or down on the proposed repeal of the state's driver's license law.
