    Family wants Ozark County woman charged for helping illegal immigrant/murder suspect

    GAINESVILLE, Mo. -- A year-and-a-half-old murder case in Ozark County took a turn on the courthouse lawn on Thursday.


    "We just want justice," many signs read.


    Family and friends of Alonzo Foster Jr. were out in force, picketing.


    "Our lives are shattered," said Alonzo Foster Sr.


    In July 2008, the 22-year-old man whom they called Zo was fatally shot at a picnic on Lick Creek. An illegal immigrant from Mexico, Jesus Sesena-Murrieta, was charged with second-degree murder.


    "The woman that was harboring him, she's been held responsible for nothing," said the victim's sister, Jacky Holt-Foster. "We have no peace, no closure."


    That woman's role in harboring Sesena-Murrieta was the focus of the picket.


    "If she had not allowed him to stay with her, keeping him on her property, he would not have been there to shoot my son," said Foster.


    "(Sesena-Murrieta) may have pulled the trigger," Holt-Foster said, "but she gave him the things he needed to do it."


    When it comes to this woman, it's KY3's policy in this story and all stories to not name parties unless charges have been filed.


    All the Fosters and their family and friends want is justice for Zo but the sheriff says his hands are tied.


    "If there was a law where I could do it, I'd do it," Ozark County Sheriff Raymond Pace said, "I'd have no problem putting them away."


    The sheriff says this is a federal ordeal. The U.S. Immigration and Customs Enforcement's Springfield office says it is aware of the case.


    "(At this time) we're not going to do anything to muddy the water, or jeopardize the state's criminal case," said ICE's Mike Spinella.


    Spinella went on to say the statute of limitations for a case like this is usually five-years.


    "It just seems like your country's letting you down," Foster said. "She's doing whatever she wants, having fun; my son can't do that."


    "People think in time it fades away. It doesn't," said the victim's sister, Christina Foster.


    A trial date has yet to be set for Sesena-Murrieta. Witnesses say Sesena-Murrieta claimed Foster was trespassing with family and friends while picnicking along Lick Creek.


    The ICE office and Foster family directed KY3 to Sec. 8 u.s.c. 1324 in regards to any person harboring a known, illegal immigrant.


    The Fosters also want agents to look at Sec. 18 u.s.c. 922 paragraph d-5 when it comes to Sesena-Murrieta having and using a firearm.

    I hope they sue the woman for all she owns. Anyone harboring an illegal alien should be held liable for crimes they commit.

    If one risks losing their home or business, one will be less likely to harbor illegal aliens.

    This illegal thought it was normal to kill trespassers? He's got huge cajones considering he himself is trespassing in this country.

    Family outing turns deadly

    Alonzo Foster Jr., 22, of Ash Flat was shot and killed July 20 at Lick Creek in Ozark County, Mo., while picknicking with family.
    Foster and about 10 people, including his mother and father, were picknicking and swimming at a place they had been "thousands of times," according to Foster's parents, Alonzo and Sandy Foster also of Ash Flat. Despite the frequent visits to this area, on this particular outing, a local resident of the Mammoth, Mo., area protested to the visitors that they were trespassing on her land.

    At around 4 p.m., the landowner Alicia Sanders confronted the family about being on her property, according to the Ozark County Sheriff Raymond Pace. Accompanying Sanders was her 26-year-old son-in-law Jesus Sesena-Murrieta.

    As Pace reported, an argument began to ensue involving shoving, at which time Sesena-Murrieta pulled out a .38-caliber, snub-nosed pistol and shot the Ash Flat resident four times.

    Although reports say fighting preceded the gun shots, Alonzo and Sandy Foster claim they heard no fighting and were preparing to leave when their son was shot. Foster said as they spoke to Sanders and had agreed to leave, they heard gunshots coming from behind them a few feet away. No loud words or fighting between his son and Sesena-Murrieta occurred, the Fosters said.

    Foster's parents also reported that Sesena-Murrieta rode a 4-wheeler down to the bank of the river for a short time and left prior to the incident.

    Foster died at 10:30 p.m. after being taken to Baxter Regional Medical Center later that day, according to Pace. Foster's parents, along with about 200 friends, were at the hospital that night as Foster was pronounced dead and his body was transferred to Cox South Hospital in Springfield, Mo., for an autopsy that was scheduled for July 22, Pace said.

    According to local authorities, Sesena-Murrieta, residing in Mammoth at the time of the shooting, fled to Gassville. Shortly after, Sesena-Murrieta's wife convinced him to return and he turned himself into police. Police then discovered that Sesena-Murrieta was illegally in the United States and was a citizen of Mexico.

    Ozark County Sheriff's Department and the U.S. Bureau of Alcohol, Tobacco and Firearms officials searched all day July 21 for the pistol used by Sesena-Murietta but were unable to recover it, Pace said.

    According to authorities, Sesena-Murietta is being charged with second-degree murder and armed criminal actions and will remain in the Ozark County jail with no bond until his court date on July 29 at 9 a.m.

    Family members say they are satisfied with the alleged offender receiving no bond because if he were released it is likely he would attempt to flee. The family also said they are just hoping that justice will soon be served and those responsible will be held accountable.
