    In an exciting turn of events, NC Governor Mike Easley has stated that HB 1183 violates Federal Law. The amazing thing is that Americans for Legal Immigration PAC released this information on 4/19/2005! The press did not report this or that online opinion polls show 90% or more North Carolinians oppose HB 1183!

    Now, it's Governor Mike Easley to the rescue. We are glad the Gov has made this statement for us as it helps to further ruin HB 1183.

    Now we want to know if he will help us get legislation that through that will stop the NC DMVs from giving licenses to illegals like Candy. Governor Easley has been a great friend to illegal aliens seeking NC licenses during his first 5 years in office.

    RALEIGH - Gov. Mike Easley says a nine-year-old federal law prevents North Carolina from giving lower, in-state tuition rates at the state's colleges and universities to illegal immigrants, as a bill in the General Assembly proposes.

    "The bill is in violation of federal law," Easley said Wednesday in Charlotte. "Federal law prohibits states from giving in-state tuition to illegal immigrants unless they also give it to (others)."

    Easley, referring to research compiled by General Assembly analysts, said a 1996 federal law requires that if a state gives a benefit such as in-state tuition to illegal immigrants based on their residency in the state, it must do the same for citizens of any other state who now pay out-of-state tuition.

    "Every U.S. citizen has to get in-state tuition," said Gerry Cohen, director of the bill drafting division of the General Assembly, who researched the issue.

    Such a move is impossible, since it would deliver a devastating financial blow to the university system.

    Telephone and e-mail messages to the bill's four primary sponsors were not returned Thursday.

    The bill, introduced last week, has prompted a fusillade of criticism that has filled legislators' e-mail and voice-mail boxes, ricocheted around talk radio and driven several of the bill's co-sponsors to drop their names from it.

    Raul Gonzalez, legislative director for the National Council of La Raza in Washington, said the federal law cited by Easley is "definitely an overreach by Congress to tell states what they can do for residents of their states."

    Jack Holtzman, a staff lawyer with the N.C. Justice Center, said the ultimate goal is fair treatment.

    "Treat people who pay taxes just like everybody else who pays taxes," said Holtzman, whose group advocates for the poor, "regardless of whether they have a piece of paper that says their parents brought them here with permission."

    Advocates of in-state tuition for illegal immigrants say it is not based on residency, as the federal law mentions, but on stipulations such as: acceptance at an N.C. college or university, graduation from an N.C. high school and four years attendance at N.C. schools.

    Cohen, however, said those conditions in the N.C. bill are "a residency requirement dressed up." N.C. colleges require a high school diploma before admission and high schools require four years of education for a diploma, he said.

    At least seven states already allow in-state tuition for illegal immigrants, but a lawsuit in Kansas over this issue is scheduled to go to trial next month, according to Dan Stein, president of the Federation for American Immigration Reform. FAIR opposes the in-state tuition laws and is a party in the Kansas case.

    Proponents of the N.C. bill, including former Gov. Jim Hunt, argue that children of illegal immigrants shouldn't be punished because their parents moved here. They say that since the children are here, it's better for them to be educated, productive members of society than a costly burden on social services.

    Critics contend the word "illegal" in illegal immigrants says it all. People in the country in violation of the law shouldn't be rewarded for it, the argument goes. Opponents charge that a student space given to an illegal immigrant would come at the cost of a child of N.C. residents who live here legally and pay taxes.

    Congress passed the 1996 law to try to curb illegal immigration by making it less attractive through the denial of some public assistance.

    "The federal law is designed to punish people," Cohen said.

    The law takes an indirect route in doing so. Instead of directly depriving illegal immigrants of a benefit, the law requires states to provide the benefit to everyone. The related costs force states not to provide the benefit to illegal immigrants in the first place.

    The Gov

    Finally! Our Governor did something I approve of!

    He also states it is against Federal Law. So why can't we take them to the nearest Military Base and drop them off to the Officer in Charge at the Front Gate and let them put them in the Brig? The MPs are already there anyway!

    Forgive me but LESS ATTRACTIVE? They truly believe that the American population are a mass of stupidity.

    There should be NO ATTRACTION not "LESS"
