A federal appeals panel has reversed the conviction of a woman arrested during a 2006 immigration raid at a Grand Island meatpacking plant.
The panel took the action because it said she didn't know she was using someone else's identification.
A ruling issued Thursday by the 8th Circuit U.S. Court of Appeals sent Silvia Ochoa-Gonzalez's case back to the district court for further proceedings.
Ochoa-Gonzalez argued that a U.S. Supreme Court decision invalidated her guilty plea for aggravated identity theft. The high court's ruling said to be convicted of that crime, a defendant has to know that the identity stolen belongs to a real person. She admitted she only knew it was fake.
Ochoa-Gonzalez's attorney, John Vanderslice, didn't immediately return a message left Thursday seeking comment.
