    Nearly 200 illegal immigrant inmates transferred from state custody

    Nearly a year after the Oklahoma Criminal Illegal Alien Rapid Repatriation Act went into effect, 185 immigrant inmates serving time in state custody have been handed over to federal officials and deported. So far, eight have returned.

    A year-old state law is saving Oklahomans millions of dollars by deporting illegal immigrant criminals back to their home countries.

    Oklahoma is one of about five states using similar methods to ease inmate overcrowding in prison systems, federal immigration officials say.

    What the heck is rape by instrumentation? Do I really want to know? BTW, isn't it a felony to return to the U.S. once you've been deported? Someone clear this up for me.

    It depends on why a person gets deported and how many times they were deported.

    An Aggravated Felon can never return to the U.S.

    An illegal alien, with no criminal record, who was deported is inelgible to receive a visa for a set amount of time, either 5, 10, or 20 years. This can be overcome by applying for a waiver from the Secretary of the Department of Homeland Security.

    In most cases, someone with family ties in the U.S. can apply for and receive a waiver of some sort to return legally.

    Non-citizens are subject to deportation regardless of:

    their immigration status
    how long they have lived in the US or had any legal immigration status
    the existence of immediate family members who are US citizens
    the strength of their ties to the community.
