Neb- Fremont : High court should hear immigration case

Neb. city: High court should hear immigration case

    July 21, 2009 1:45 PM ET

FREMONT, Neb. (AP) - Fremont city leaders have asked to bypass the state Court of Appeals and take the city's dispute over a proposed illegal-immigration ordinance to the Nebraska Supreme Court.

City Attorney Dean Skokan made the request Monday. The city is appealing an April ruling from a Dodge County district judge. It concluded the city must hold an election on a proposal to ban renting to and hiring illegal immigrants in the city.

City leaders say the proposal is unconstitutional. But Judge John Samson said that matter was out of his hands until voters approved the measure.

In briefs filed with the Court of Appeals, the city argues Samson wrongly treated the issue like a statewide initiative. He says courts have broader authority when it comes to a city initiative.
