The lawyer for a teacher accused of having sex with a former student and fleeing to Mexico said he wants to get the federal case against her dropped in exchange for her pleading guilty to state charges of statutory rape.

Kelsey Peterson of Lexington faces a federal charge of crossing a border to have sex with a minor.

James Martin Davis, who represents the 26-year-old former teacher, said Thursday in U.S. District Court here that if he can't settle the federal case, he wants the court to order the boy's mother to be deposed.

Martin said Peterson told him that the boy's mother advised them on the logistics of their trip.

The pair left Lexington in late October and were found in Mexico a week later.

She should be prosecuted. Was his mother aware of this "relationship?"

The mother is an illegal alien and should be deported not deposed. She's known about the relationship for some time. In my humble opinion mom is just here to suck up welfare and benefits for her illegal alien children and her anchor babies. One of the rumors was that she was getting welfare for Fernando. It's also been reported that Fernando was in a boys home. Who do you think paid for that?

This family is typical lying illegal alien scum with NO family values and the whole family should be deported. The teacher is in jail where she belongs and I am not feeling sorry for her at all.

There was also some talk about the boy not being 13, but 17? The lawyers had TWO Mexican birth certificates for him, one for each age.

It was also written that he had a 3 year old son? I don't know of ANY 13 year old boy with a 3 year old son. Is it even possible?

Peterson is where she belongs, she knows she did wrong. The boys' family should be deported, all of them.
