    NEW DELHI: It could be bad news for those with non-immigrant work (H-1 B) visas who were expecting to be on the fast track to a Green Card or employment-based immigration visas. The US government is expected to revise its earlier decision to accept applications for a change of status from an H-1 B visa to an EB-3 immigrant visa or a green card.

    In late June, US department of state in its July visa bulletin announced the government’s decision to would accept the applications for an adjustment to permanent resident status from non-immigrant work visa holders who had received their labour certificates.

    Sources indicated that US department is to revise the July bulletin, expected to be issued on Monday or Tuesday. The bulletin had stated that all non-immigrant visa holders with labour certifications could move ahead their green card cases and submit their application for adjustment of status, which is the final stage for a green card.

    If the US department does revise the bulletin , it is expected to “retrogressâ€

    US law limits the number of immigrant visa numbers that are available every year. As a result, an applicant may not get an immigrant visa number immediately after the immigrant visa petition is approved. In some cases, several years could pass between the time USCIS approves the visa petition and the state department assigns an immigrant visa number.
    Oh? Is that the way it's supposed to work?
