    Police, ICE Agents Disagree On Hernandez Case

    Shaun Boyd AURORA, Colo. (CBS4) ― Federal immigration officials fired back Tuesday after accusations they let an illegal immigrant free before he allegedly hit and killed three people in Aurora last week.

    Francis Hernandez faces multiple charges, including vehicular homicide, in connection with the deadly accident at an ice cream store near Havana and Mississippi last Thursday night.

    Hernandez had been arrested 16 times before the accident, most recently in April when Aurora police said they asked Arapahoe County's Sheriff's Office to check his immigration status.

    Sheriff Grayson Robinson told CBS4 he believes that happened.

    "But at the same time, we cannot produce any documentation that we made that inquiry, so I will stand that my staff tells me they made the inquiry," Robinson said. "We're not able to document it, so I can't say that we did in fact make the inquiry."

    "We have been unable to find any indication that any law enforcement agency has contacted us about Mr. Hernandez," said Tim Counts, a spokesman for Immigration and Customs Enforcement. "We did, on our own, after we had seen news reports about the accident, our agents did reach out and interview Mr. Hernandez and it was at that point after several tries that he finally admitted that he was in the country illegally and was from Guatemala."

    Robinson said even if they had contacted ICE agents last April, it is unlikely they would have detained Hernandez because he was suspected of misdemeanors at the time.

    ICE agents typically only issue detainers for suspected illegal immigrants for serious felonies or violent offenses.

    We have been unable to find any indication that any law enforcement agency has contacted us about Mr. Hernandez," said Tim Counts, a spokesman for Immigration and Customs Enforcement. "We did, on our own, after we had seen news reports about the accident, our agents did reach out and interview Mr. Hernandez and it was at that point after several tries that he finally admitted that he was in the country illegally and was from Guatemala."
    Sounds like the same BS we always hear when an American citizens loses their life at the hands of an illegal invaders with a considerable rap sheet!

    IT'S NOT MY FAULT! How many more times do we as a nation have to accept this garbage from those who are positions of power and are to be protecting us from this.

    Looks to me, they ( police dept.) need to revise their procedures. If they fail to document an incident, it didn't happen. I recommend they review their procedure and implement a corrective measure to insure 100% of these cases are documented when they are reported to ICE. I suspect they never reported it, since they never documented it. They wish they had, but they didn't.

    Couldn't agree with you more MGY! ICE should be notified every single time an illegal invader is apprehended, irrespective of what they have done! The only concern from ICE should be that they are in this country illegally! That in of itself should be enough to warrant ICE picking these people up. If you do not have enough manpower, then get more manpower!

    And local authorities has better start documenting all correspondence with ICE, especially if ICE refuses to pick up an illegal invader in local custody for deportation.

    I'm with you however! I doubt ICE was ever notified! Now, the local officials are simply trying to shield themselves from the backlash and any responsibility for this scofflaw being in this country. The fact they can deny any responsibility, would suggest there is no system in place to guide communications between local law enforcement agencies and ICE officials. That also has to change.

    I agree with you magyart. ANY good secretary or supervisor knows that. They need an organization person in their department. I smell a lawsuit coming.
