    A Morris County grand jury indicted two homeless day laborers -- an uncle and his nephew -- yesterday on charges related to the death of a 36-year-old immigrant from Mexico, the Morris County Prosecutor's Office said yesterday.

    Mario Nieto-Rivera, 34, an illegal immigrant from Mexico, was charged with first-degree murder, third-degree hindering apprehension and second-degree tampering with human remains, authorities said.

    Homeless man admits killing day laborer in Montville

    A homeless man has admitted killing a day laborer whose decomposed body was found in a Morris County industrial tract, and his nephew admitted today to helping hide the body.

    Marcos Jose Nieto-Riveria and Mario Nieto-Rivera
    Mario Nieto-Rivera, 34, pleaded guilty Tuesday to first-degree aggravated manslaughter. He faces an 18-year prison sentence for the death of 36-year-old Alfredo De Los Santos Francisco.

    His nephew, Marcos Jose Riveria, 23, pleaded guilty this morning to disposing of human remains and faces up to five years behind bars. Authorities say he helped his uncle remove the victim's body from an abandoned Montville home.

    Nieto-Rivera, an illegal immigrant from Mexico, is expected to be deported after he completes his sentence, according to the Morris County Prosecutor's Office.

    The pair were charged shortly after the skeletal remains of an unidentified man were discovered on Oct. 12, 2006, by a landscaper dumping leaves near the Frassetto Cos. building in Montville. The remains were later identified as those of Santos-Francisco, a day laborer from Mexico who was a friend of Nieto-Rivera, authorities said.

    Nieto-Rivera was accused of killing Santos-Francisco during a fight in an abandoned Chapin Road home. Police said he punched and kicked Santos-Francisco in response to derogatory comments Santos-Francisco made about Nieto-Rivera's mother and wife. Santos-Francisco was last seen alive on Dec. 12, 2005, authorities said.
