    This is the loophole right here:

    "However, the DHS does not have access to the "no match" list, so it will not be able to take direct action based on it. "

    So unless we do phoning to our reps to get this fixed, NOTHING will be done.

    "No Match" letters are sent to employers once a year by the Social Security Administration if the employer's batch of W-2s has 10 or more errors in the information given.


    This was the most interesting part to me. If the employer knows the letters are going to be sent once a year; say in October. He knows that he can hire illegals in November and have no responsibiliy for their fake documents during the next 11 months. Am I missing something?

    It does sound like the Bush Administration's alleged crackdown is really a case all bark and no bite. For example, in addition to the glaring loophole with the "no-match" letters, the administration said they would have 370 miles of fencing completed by December 2008.

    However, the Secure Fence Act of 2006 mandated 700 miles (or 854 miles per Duncan Hunter) of fencing. So, based on this and Bush's pathetic track record regarding border security, it does look like he is trying to stall and kill the fence outright.
