A known gang member who fled from authorities trying to serve an arrest warrant Thursday in Wilmington is now in custody.

Nahun Alberto Funez-Maldonado, 30, of Magnolia, was arrested in Duplin County on Saturday, according to Duplin County Sheriff’s Office spokeswoman Tammy DeLuca. He was apprehended after leading deputies on a brief foot chase.

Nahun Funez-Maldonado allegedly fled in the Landfall and Mayfaire area of Wilmington on foot Thursday after authorities tried to serve an arrest warrant.

Authorities were able to serve an arrest warrant that day in Wilmington for his brother, 30-year-old Marlon Funez-Maldonado.

Nahun Funez-Maldonado was wanted in Duplin County on a 2003 warrant for injury to personal property, DeLuca said.

According to U.S. Immigration and Customs Enforcement (ICE) spokesman Vincent Picard, Nahun Funez-Maldonado is a known MS-13 gang member and has been deported in the past.

DeLuca said Marlon Funez-Maldonado is also a member of MS-13 (Mara Salvatrucha), a violent Hispanic gang based in Los Angeles, Calif.

Marlon Funez-Maldonado, also of Magnolia, was booked at the Duplin County Detention Center Friday on a charge of communicating threats. He was placed under a $500 bond but is being held as an ICE detainer.

According to ICE’s website, an immigration detainer is a notice that the U.S. Department of Homeland Security issues to federal, state and local law enforcement agencies to inform them that ICE intends to assume custody of a detained individual.

Nahun Funez-Maldonado is being held under a $40,000 cash bond on a charge of injury to personal property.

According to the North Carolina Department of Corrections, Nahun Funez-Maldonado was previously convicted of second-degree kidnapping on Feb. 28, 2011. He was released from prison Feb. 28, 2012.

Nahun Funez-Maldonado is being held pending his court date and has also been placed under ICE detainer pending charges of re-entry by an aggravated felon, DeLuca said.

“Homeland Security Investigations will be presented for federal charges of aggravating felony re-entry,” DeLuca said.
