On Monday, the Miami-Herald reported that Homeland Security Secretary Janet Napolitano has just extended Temporary Protected Status (TPS) to about 60,000 Haitian nationals living in the United States.

Announcement of the extension is expected to be published in the Federal Register this week, and will take effect on Jan. 22, 2013.

The Obama administration originally issued the TPS for Haitian illegal aliens in January 2010, following that country's devastating earthquake. The status also allows them to work in this country legally.

While the measure was been seen by many as an act of American hospitality, it has also made the possibility of ever deporting the illegal aliens, many of whom are convicted criminals residing in federal detention centers, rather unlikely.

The federal government actually has a history making the "temporary" status permanent.

Honduran and Nicaraguan nationals received the protected status in 1999, after Hurricane Mitch hit their countries. Salvadoran nationals were also granted the same protection from deportation, after an earthquake hit El Salvador in 2001.

Despite the time which has passed since both disasters, their legal status in this country remains in place.

In fact, in January 2012, the Obama administration issued yet another extension of the TPS, originally granted to 217,000 illegal aliens from El Salvador.

According to the Department of Homeland Security, due to the earthquakes in 2001, "El Salvador remains unable, temporarily, to handle adequately the return of its nationals."

Somali and Sudanese nationals also enjoy the special status. Of course, it has recently come to light that many Somalis who were allowed to immigrate to this country have become radicalized Muslim terrorists.

One Haitian whose deportation was stayed by Obama was Kesler Dufrene, a twice-convicted felon and illegal alien who murdered three people, including a 15-year-old girl last year.

Though an immigration judge ordered that Dufrene be deported when he got out of prison for burglary in October 2010, but due to the TPS, immigration authorities in Miami had no choice but to release the illegal alien back onto the streets.

On January 2, 2011, Dufrene shot three people to death, according to North Miami police.

However, the Haitian national was never be brought to justice. Nearly three weeks later, he shot himself while surrounded by Manatee County sheriff’s deputies, who came looking for him following another break-in and shooting.

DNA evidence later linked Dufrene to the murders.

Temporary Protected Status Extended for Haitians

DHS also extends the suspension of certain requirements for F-1 nonimmigrant Haitian students
    Released Oct. 1, 2012
WASHINGTON—Secretary of Homeland Security Janet Napolitano has extended Temporary Protected Status (TPS) for Haiti for an additional 18 months. Napolitano is also extending the suspension of certain requirements for F-1 nonimmigrant Haitian students.

The extension of TPS for Haiti will begin Jan. 23, 2013, and end July 22, 2014. Secretary Napolitano first designated Haiti for TPS on Jan. 21, 2010, after major earthquakes devastated the country.

Current Haitian TPS beneficiaries, who have continuously resided in the United States since Jan. 12, 2011, and seek to extend their TPS status, must re-register during the 60-day re-registration period that runs through Nov. 30, 2012, if they wish to maintain their TPS. U.S. Citizenship and Immigration Services (USCIS) encourages beneficiaries to re-register as soon as possible within the 60-day period. USCIS will accept applications starting today through Nov. 30, 2012. Individuals who have not continuously resided in the United States since Jan. 12, 2011, will not be eligible.

The 18-month extension also allows TPS re-registrants to apply for a new Employment Authorization Document (EAD). Eligible Haitian TPS beneficiaries who timely re-register will receive a new EAD, if requested, with an expiration date of July 22, 2014. USCIS recognizes that all re-registrants may not receive their new EADs until after their current EADs expire. Therefore, USCIS is extending currently valid TPS Haiti EADs bearing a Jan. 22, 2013, expiration date for an additional six months, through July 22, 2013.

In addition, the Department of Homeland Security (DHS) is extending the suspension of certain requirements for F-1 nonimmigrant Haitian students. The extension will enable these F-1 students to continue to obtain employment authorization, work an increased number of hours while school is in session, and reduce their course load, while maintaining their F-1 student status. The suspension of the regulatory requirements will remain in effect for an additional 18 months, through July 22, 2014. Further details about this extension may be found in the Federal Register notice published today.

For information on the TPS application process and eligibility requirements, go to www.uscis.gov/tps. Further details about this extension may also be found in the Federal Register notice published today.
