    An appellate court has reversed a Westbury Village justice's decision to throw out a charge against a man accused of driving without a license, because the justice raised issues that the man's own lawyer didn't raise.

    In December 2007, Village Justice Thomas Liotti issued a decision dismissing a charge of unlicensed driving against Rafael Quiroga Puma, 22, suggesting that Puma could not get a license because he is an illegal immigrant. Liotti went on to say that the state code on unlicensed driving is unconstitutional because it does not allow illegal immigrants to get driver's licenses.

    But an appellate decision released this week said that lawyers in the case had not presented any evidence to show that Puma, who had three prior convictions for unlicensed driving, was an illegal immigrant or that he had ever applied for a driver's license.

    The decision also said that even if Puma had established that he had standing to challenge the constitutionality of the Department of Motor Vehicles' policy of not giving driver's licenses to illegal immigrants, Liotti should have notified state Attorney General Andrew Cuomo's office and given it a chance to respond to the issue.



    Liotti said he was prohibited from commenting on the decision except to say that he "respectfully disagrees with the decision, but must follow the higher court's ruling."

    Westbury Village Prosecutor Dwight Kreamer said he agrees with the appellate court decision. He said Liotti did not hear evidence from him or from Puma's defense attorney, Bertram Jorisch of Jericho, before rendering his decision.

    Jorisch could not be reached for comment Friday.

    The case will now return to the Westbury Village Court, lawyers said. Kreamer said he expects that the parties will reach a plea agreement.

    Driving is a privilege, not a right! Licenses can be taken away or suspended for US citizens as well. But since this guy is illegal, I suppose he feels himself more worthy than legal immigrants and citizens.

    Is this guy for real? I suppose if we restrict giving pilots licenses to terrorists that's unconstitutional also. What a maroon. I guess we can't restrixt anything w/o being unconstitutional.

    So that corrupt third world drug cartel member posing as a justice justifies someone driving without a license endangering innocent Americans by saying he wasn't allowed to have a license because he was illegally in this country. What have we come to? We are a lawless corrupt third world country because of the never ending invasion of those from lawless corrupt third world cesspools who have brought those values with them supported by this third world mob, union and drug cartel owned and run administration, congress, ACLU, law enforcement and other agencies.
