Officer shoots illegal alien car theft suspect in CA

    Officer shoots car theft suspect
Written by Ben Marrone / Sun Post Friday, 28 September 2007

MANTECA, CA — A local police officer shot and wounded a man who had allegedly tried to run him over while fleeing in a stolen car early Tuesday morning, Sept. 25.

Officer Robert Anderson reported that he’d tried to get the car to stop by yelling and waving his flashlight, and then fired three rounds as the driver continued toward him at full speed.

The driver, later identified as 20-year-old Jose Luis Ayala, was hit once in the right hand before he swerved around Anderson, police spokesman Rex Osborn said. Ayala then led officers on a chase for nearly 40 miles to an Interstate 580-Interstate 680 interchange in Pleasanton, where the California Highway Patrol laid out a spike strip to slow the car down, Osborn said.

It was about 1:30 a.m. when Manteca police responded to a call from a resident who said he’d caught someone trying to break into his car, in the normally quiet neighborhood of Sextant Way and Sunfish Drive in southwestern Manteca
    .
Officers searched yard by yard for the man, when a resident on the next street, Compass Lane, found Ayala trying to hotwire his car, according to the police report.

Ayala ran back to the car he had arrived in — which had been stolen hours earlier from a nearby neighborhood — as Manteca police officer Aaron Montoya ran over to stop him.

Montoya smashed the window on Ayala’s car with his baton and tried unsuccessfully to stun him with a Taser gun as Ayala drove toward Anderson.

After Ayala was arrested, he was taken to a hospital in Pleasanton, where he underwent surgery on his hand. He was then booked into San Joaquin County Jail in French Camp on suspicion of assaulting a police officer with a deadly weapon, carjacking and other charges.

Detectives interviewed Ayala’s parents in Modesto and said they believe Ayala is an undocumented immigrant from Mexico. They have notified Immigration and Customs Enforcement officials about his arrest, Osborn said.

Ayala is being held on $560,124 bail and was scheduled for arraignment in Manteca Thursday afternoon.

Meanwhile, Anderson was placed on three days paid leave, which is standard protocol following an officer shooting. Anderson has been with the department for six months. Before that, he worked for the Contra Costa County Sheriff’s Office.

The Manteca Police Department and San Joaquin County District Attorney’s Office will investigate the shooting together, Osborn said.
