    Immigration officials say the suspected Los Angeles street gang member charged in the shooting death of a high school football star may have been in the country illegally.

    U.S. Immigration and Customs Enforcement spokeswoman Virginia Kice said Saturday her agency has filed an immigration hold against 19-year-old Pedro Espinoza.

    The hold means Espinoza will be transferred into her agency's custody for possible deportation when he leaves local custody.

    Espinoza was released from jail in an assault case the day before the March 2 killing of 17-year-old Jamiel Shaw Junior.

    Kice did not know if there was a hold on him during his previous sentence, but said inmates on hold are generally released directly into her agency's custody.

    This burns me up to no end. So I guess an illegal gang banger has to take the life of an innocent kid before an immigrations hold will be placed on this scum bag. You cannot tell me this is the first time this piece of garbage has been in police custody!

    It's time for a serious civil suit against the police department and the city of Los Angeles for negligence in their refusal to notify ICE when these illegal gang bangers are arrested!!

    The alleged gang member accused of killing Los Angeles high school football star Jamiel Shaw is in the country illegally and had been released from jail without anyone questioning his citizenship the day before Shaw's shooting, according to a report by MyFOXLA.com.

    Meanwhile, Mayor Antonio Villaraigosa on Saturday afternoon was scheduled to join with Shaw's family to dedicate a memorial honoring the 17-year-old at the spot where he was killed.

    Police say Pedro Espinoza, the 19-year-old suspect arrested in Shaw's death, has been in a street gang since he was 12. Until this month, he had been in jail on charges of exhibiting a firearm and obstructing an officer, MyFOXLA.com reports.

    Immigration officials told the TV station that Espinoza is an illegal immigrant, but no red flags were raised when he was released from jail March 1.

    "The system is not 100 percent," Lori Haley, a spokeswoman for Immigration and Customs Enforcement, told the station.

    Police say Shaw was walking home from a mall on March 2 when Hispanic gang members pulled up in a car and asked him, "Where are you from?" — code for what gang did he belong to, police said. Espinoza then allegedly shot Shaw, who was not a gang member.

    Espinoza was arrested March 7 and charged with murder. The charge has been labeled gang-related, which could make him eligible for the death penalty. He is scheduled to appear in court Tuesday.

    Police still are looking for a second man thought to be Espinoza's accomplice.

    Police said Shaw was a standout running back and a good student at Los Angeles High School. He also was the Southern League's most valuable player last season and had been recruited by universities including Stanford.

    Shaw's mother, Army Sgt. Anita Shaw, had been serving in Iraq but returned home when her son was killed. She is slated to redeploy to Iraq to finish her second tour of duty despite dozens of letters sent to her Army supervisors asking for an exemption.

    What does it say about the sad state the US is in when this family raised their son to be a fine, upstanding American and an illegal alien who has been in trouble since age 12 shoots him for no reason at all. This is a hate crime.

    I sincerely hope they sue the Los Angeles, California and the President and Congress.

    This breaks my heart.

    An alleged gang member accused of killing a 17-year-old high school student just one day after being released from jail has been living in the country illegally, possibly for more than a decade, federal immigration authorities said Saturday.

    The Immigration and Customs Enforcement agency has filed paperwork naming 19-year-old Pedro Espinoza, the suspect in the March 2 killing of Los Angeles High School football star Jamiel Shaw Jr., as a potential candidate for deportation.

    Virginia Kice, a spokeswoman for the immigration agency, said an immigration hold was issued for Espinoza on March 13, nearly a week after he was arrested in connection with Shaw's death.

    No such hold was placed on Espinoza on March 1, the day he was released from a Los Angeles County jail after serving roughly four months for exhibiting a firearm and resisting arrest, said Sheriff's Department spokesman Steve Whitmore.

    "We are going to follow up to determine whether or not we have had prior interactions with this individual," Kice said.

    The federal immigration agency confirmed the deportation filing on the same day that Los Angeles Mayor Antonio Villaraigosa participated in a ceremony dedicating a memorial in Arlington Heights where Shaw was killed.

    A highly regarded running back for his school's football team, Shaw was named the Southern League's most valuable player in 2007. He had drawn the interest of recruiters from Stanford and Rutgers universities, his family said.

    The killing outraged civic leaders and reignited a citywide debate over the role that race has played in a recent spate of homicides.

    Both the immigration agency and the Sheriff's Department have employees who interview jail inmates about their immigration status. Those interviews can be undermined when inmates give aliases or inaccurate places of birth, authorities said.

    After his most recent arrest, Espinoza was "uncooperative," telling immigration investigators he did not know where he was born or the whereabouts of his family, Kice said.

    The next day, investigators found a relative of the suspect who said Espinoza had been smuggled into the United States from Mexico when he was 4, Kice said.

    In the greater Los Angeles area, the immigration agency files several thousand immigration holds each month on inmates who are considered deportable, Kice said. Those inmates are identified as deportable if they are living in the country illegally or if they are legal residents who have been convicted of certain crimes.

    The immigration hold placed on Espinoza will mean little if he is convicted of first-degree murder.

    "If this prosecution goes forward and he's convicted, in all likelihood he's looking at a very, very severe sentence," Kice said.

    Thank god he didn't flee to Mexico or the death penality would have been out of the question in order for Mexico to extradite back to the states.

    This is another area in which Mexico has us over the barrel. They have 20-30 million of their people living in this country illegally, and we have to promise them we will not seek the death penalty in order to get these criminals back into the US to face prosecution.

    Just happened to be listening to Doug McIntyre this morning, and the entire city is outraged by this heinous crime! Doug promised to contact Judicial Watch and bring them on the show this week. The plan is to find out if a class action lawsuit can be brought against the city of LA for not enforcing existing laws and harboring a criminal.

    The audacity of this city's Mexican mayor's refusal to enforce immigration laws is the reason crime is soaring in LA! The illegals ALL know that they can get away with murder, and they are doing exactly that...murdering our people! The corrupt mayor is aiding and abetting them, along with his lackey, Chief Bratton! The illegals LOVE both of these criminals!s

    We need to start at the top of the heap and throw out every single Mexican in office! This city is being ruled by Vicente Fox, Calderon, and Villaraigosa. LA is Mexico!
